This contrasts dramatically with SM and Avex who have been so predictably inconsistent, changing their positions and eating their words multiple times.
[INTERVIEW] Attorney Im Sanghyuk, the Legal Representative of the 3 Members
The legal representative of the 3 members, attorney Im Sanghyuk (Lawfirm Sejong) revealed in an interview with this reporter on the 17th that: “Avex demanded multiple times for changes to the contract that the members could not easily accommodate, such as the ratio of profit distributions and more.”
Attorney Im Sanghyuk disclosed: “In particular, even though it was agreed that with regards to the activities of the members all points would be proceeded with upon obtaining consent of both parties through reaching an agreement, among the demands that Avex made were the power to determine the schedule unilaterally, and such other contents which could not be easily accepted on common-sense grounds.”
Attorney Im explained the theory that Avex has put up as the excuse for suspending JYJ’s activities, that the director C-JeS was connected with a gang: “The person in question, Director Paek himself, has gone so far as to notify Avex that if such was really the problem he would get out of the contractual relationship, but Avex did not accept this. In the end, we came to the conclusion that to proceed [with the relationship/discussion with Avex] in a normal manner would be difficult.”
In fact, the members of TVXQ had revealed in a previously-announced press statement that said: “Many months ago, Avex has cited the above reason to demand a contract that excludes C-JeS, and the 3 TVXQ members have accepted this in order to do activities in Japan smoothly and diligently participated in the discussions of renewing the contract.”
Attorney Im said: “If one examines the series of events, there are many circumstances (asserted) by Avex that can only be accepted only when forcibly [stretching one’s logic/imagination]. If Avex refutes this, our side will make public additional contents.”
Attorney Im added: “The essence of this dispute is that contrary to the content of the existing contract, the management company has presented conditions that are unilaterally disadvantageous to the affiliate entertainers and so have suspended their activities without regard to the intent of the members. Despite this, it is saddening because it seems that the focus is becoming dimmed due to the attention of the public flowing to the director of C-JeS who has no relation to a gang.”
Attorney Im criticized that “it is an immoral deed to tie the feet of TVXQ because Avex cannot fulfill its avarice,” and repeatedly emphasized: “I will put much effort to resolve this without fail so that the 3 members can engage in activities in Japan smoothly.”

sounds to me like they got some damning stuff on Avex.

The contract terms can be revealed now.
The contract will likely be the primary piece of evidence in the court action, so it would be inappropriate to release it now. But it will soon be in the public record.
That’s what I was trying to say, lol. Once the lawsuit commences, and the contract is offered as evidence, we can finally know its terms. It’s one of the advantages of the lawsuit. ^_^
Why do I get the feeling they may be mentioning how Mr. Paek was brought into the mix? Let’s be real, SOMEBODY brought him in to this deal, he didn’t just walk in off the streets. So, WHOMEVER this was, knew all about the man’s past.

AVEX makes a lot of generalized claims, along with some half-truths. Not being honest is a serious character flaw AVEX. You can be called on it.
Well, I always have the feeling that AVEX did it on purpose, they know exactly who Mr. Beak was and what kind of (criminal) past he may has. Avex introduced him to JYJ, because they thought if something doesn’t go the way Avex want it to be with JYJ, they can used Mr. Beak’s “past” to push all the faults to JYJ and him.
And that’s why when Mr. Baek said he would back off from the contract if his past would cause problems for JYJ, AVEX DID NOT ALOUD him to do so.
Avex, you fail another round.
Like SME, Avex only wanted to slave the boys in order to profit on them. ¡GREEDY LIARS!

AVEX has a history like SME, of thinking people forget important information. So, when they run their mouths, they think everything they say will be taken for gospel. This is one way to say, ‘WRONG’! Helps keep them honest.

JYJ didn’t want to accept the unfair terms so Avex threw a hissy fit and used the Baek/mafia as a cover up to suspend JYJ’s contracts. I say good for JYJ for saying no. It makes no sense for them to get out of one unfair contract only to be bind with another one.
Avex don’t care about these boys. They know damn well what their accusations about JYJ/Baek/mafia could do to JYJ’s reps.

I remember seeing a photo of one of the JYJ attorneys being inteviewed by the press at the court building after the intial pleading was presented. I don’t recall if a name was given, but the gentleman was distinguised looking. He had a conservative haircut, wore glasses and had on a very nice looking expensively cut suit on. He looked liked he could be late 30’s, early 40s. Since they have a whole team, there is no way of knowing which one this was. I just made the assumption since this was the first legal action, the lead attorney would be the one representing.

So in other words, Avex wanted to hem them up and tell them what to do, when go and how; just like sme; then when they objected, Avex comes up with the “gang” excuse. This, after the members and C-Jes were willing to sever ties!!!

Hopefully, this lawsuit reveals all the dirty motivations that AVEX actually holds against the boys. The boys just have been “the” cash cow to AVEX for years, even after the suspension. It is so clear that AVEX tried to take advantage of JYJ’s difficult situation to take more, give less.
This might be slightly off-topic, but this article reminded me of all the wank this attorney received last year, lol. The comments of how JYJ should have hired better lawyers because their present one is an idiot and that he shouldn’t meddle in JYJ’s affairs comes to mind.
I’m really glad that JYJ3 doesn’t have any comments like this. 🙂 Honestly, this lawyer knows more than all of the fans combined, because he’s actually the one handling their lawsuits and the other incidental things (Avex contract included) that come along with it.

Some were claiming that the attorney shouldn’t have said anything with regard to Avex because that was beyond his representation as JYJ’s lawyer, which for them, is apparently only limited to the JYJ vs. SME lawsuit. Some people just felt that the attorney was overstepping his boundaries. The ‘idiot’ comments were mostly during the injunction case SME filed during “The Beginning,” where the same people were questioning the management contract JYJ entered into with C-JeS and that the lawyer should have never allowed JYJ to do so, considering that the court ruling back in ’09 in favor of JYJ did not cover that type of transaction, for lack of a better term.
They were truly interesting discussions. 🙂 And I’m glad that the lawyer is now proving his detractors wrong, if the court rulings are anything to go by.
