Avex Group Holdings Inc.
Concerning the Charity Event by JUNSU/JEJUNG/YUCHUN
There was an announcement on April 5 this year, that JUNSU/JEJUNG/YUCHUN (exclusive artists of our company, hereinafter named “JJY”) will hold a charity support event (hereinafter called “this event”) for the Tohoku Kanto Earthquake Disaster.
This event was planned without receiving any permission from our company, which holds the exclusive management rights for JJY in Japan.
Our company has protested multiple times to the organizer ZAK Corporation (hereinafter named “ZAK Corp”) and JJY’s Korean management company, C-JeS ENTERTAINMENT, Co.ltd (hereinafter named “C-Jes Corp” ). However, they have not listened to our protests, and forced through with the ticket sales unilaterally.
Concerning our company’s above handlings, we have received many comments and requests from JJY fans that this event should push through. Or, that since the sole purpose is for charity, we should especially dissolve the exclusive contract. On the other hand, we have received protests from multiple antisocial forces. Furthermore, we were under duress that our president should be harmed, etc.
However, our company holds the exclusive rights for JJY’s activities in Japan, and we have just taken actions for the infringement rightfullly and properly.
Additionally, as we have announced in our press release of September 16 last year, there remains to be compliance problems such as the criminal record of the President of C-JeS in assaulting/blackmailing an artist (of whom he was in charge of). Moreover, the exclusive contract declaratory judgment is still going on in Korea. Therefore, we have no other choice than to suspend the activities of JJY until these are settled.
In spite of the above circumstances, ZAK Corp and C-JeS have in their joint names, and, as ZAK Corp by itself, have filed two provisional dispositions against our company to the Tokyo District Court, claiming that our company’s handlings have no legitimate basis.
Hereafter, our company will contend our legitimacy at the judicature.
Our company does not think that the JJY members themselves are aware of everything that is happening.
Our company wishes that the JYJ members will understand the situation correctly and the real intention of our company.
Additionally, as we have been consistently commenting, our company long for the day where the compliance and legal problems in Korea will be resolved, and that our company can once again manage JJY. Furthermore, to resume the artists’ activities as Tohoshinki . We will do our best in the future.
For the fans who support JJY, we understand that we are making all of you worry.
We appreciate your kind understanding on the above.

Please don’t get yourself overly upset…JJY is the original signature the guys used when they started out under AVEX. If you go back and look at the promos for the Thanksgiving concert project, you will see that is how they were presented.
Luckily, they altered it to its present format once they began their activities under C-JeS in Korea. 🙂

When Avex made the contract with JYJ sometime in April 2010 if am not wrong, SM said it was unlawful and everyone wondered how it was possible because JYJ’s exclusive contract with SM still stands. Avex said that it wasn’t an exclusive contract but rather signing up as JYJ’s record company.So WTH is with them saying that JYJ had an exclusive contract with them unless its through Tohoshinki.
When the rumours about Baek came out which was all over the news in japan and korea, chiba himself told fans not to worry, “Baek was one of them”. After that they had the japanese tour, released two albums- THE, tokyo dome concert. Damn btn April till september when they were earning millions it never occurred to them that they were been unethical by doing business with Baek even when the fandom pointed it out to them.
If the lawsuit was such a big issue why the hell did they sign up JYJ in the first place. Why didn’t they terminate that contract when SM ranted about it and how come they haven’t terminated the contract now.
Chiba, Max and Avex are masters of contradictions and gotta hand it to them they’re smooth talkers but for effs sake at least try to remember what the hell you said in the past.

One important thing not to forget…when AVEX first signed the guys up…AVEX was still the second biggest shareholder in SME, right behind the $100M dollar man. That situation did not change until after June of 2010, when said agreement was coming up for renewal.
The one thing AVEX keeps forgetting in all of this as they continue to portray JYJ as innocent babes in the woods; JYJ has one of the most respected law firms taking care of their business. This law firm is not going to let them hook up with any entity or contractural agreement that is not in their best interests. The guys chose very well.
AVEX stop treating the fandom as if it is completely witless. Your efforts are not working, nor are they appreciated.

Firstly, wasn’t it reported that AVEX had recommended C-jes to JYJ? And then, correct me if I’m wrong, they’re the same ones who started these rumors of the C-jes CEO mishandling his talent and that he also has connections with the Yakuza… Oh so *now* they’re *concerned* about C-jes legitimacy? Secondly, the courts have ruled that JYJ can do work and that SM’s exclusive rights have been suspended at this point. I would assume that this decision affects all of JYJ’s contracts that they had through SM with the inclusion of AVEX because of their partnership with SM. Unless I’m wrong… isn’t AVEX the equivalent to a production company for TVXQ? Since SM has been carrying on about double contracts and how they are illegal, it surprises me how much power AVEX claims to have over JYJ. Also it gives light to how unfair that contract is.

Avex’s statement has already been addressed in the Japanese demand letter/petition.
The ongoing dispute with SME and C-JeS CEO Baek’s background were things that Avex was aware of before JYJ re-signed with them. Knowing the situation, Avex still contracted with JYJ willingly. Avex cannot anymore use these reasons for “freezing” the contract because they’re already estopped to do so.
This statement makes me want to throw up.
There’s a site in Japanese with a list of all of Matsuura’s past scandals. I don’t see how he thinks he has right to call out people about their ‘connections’ and criminal past. And what is that crap about ‘JJY’??? And Tohoshinki??? Are they trying to pretend it’s last year?

It amazes me how good liars they are and how convincing they are at it. Only those who have put the hope of DBSK/Tohoshinki behind them (at least in the near future) can clearly understand the truth.

SM just acts like an evil company and it is clear what they are doing wrong. This company always puts on a sweet smile and says, you don’t know all the secrets of why we are victims. The whole statement made me laugh hard, but this part is greatly hilarious… seriously avex, are you plotting with sme to force JYJ back to this Hell? or are you trying to get the support from OT5 fans? or both? From the moment you dropped JYJ in september, I suspected you to plot with sme to force them back there.. but unless you force them, I dont see JYJ resuming their activities as Tohoshinki willingly..
Like SM they want their cash cow back. They thought either the conflict JYJ had with SM was temporary or if they had to choose JYJ or Homin they would go with JYJ. JYJ was happy for awhile and then they proposed a contract with Avex, to which Avex said no. “That contract is unacceptable, blah blah” and they decided to suspend JYJ’s activities in Japan rather than risk losing them so that they could sign on to some other company. Then they willingly signed on the 2 member DBSK because it seemed at the moment that they would be the ones to bring in major profits. They did well but not as good as before so they decided to still hold on to JYJ.
They still have rights over JYJ’s materials in Japan (which you guys know they have no qualms making a profit off) and get to block them (I guess until JYJ gives in) under the pretext that they have problems they need to resolve in Korea first before they can allow them to perform in Japan again. In the meantime SM conveniently continues their annoying lawsuit case just to buy more time so that they can harm JYJ as much as possible. Interfering with TV appearances, spreading faulty info etc.
It would be bearable until the courts make a final decision. Then Avex/SM would have no excuses and JYJ can move on. But what do they have as a final resort?….Manipulating some gullible fans into thinking that JYJ will go back to DBSK. That way if JYJ decides not to go back to SM/Avex then SM/Avex can claim that JYJ are heartless because they don’t want to go back to their “brothers” in DBSK. This would give them some power in implementing a still shitty, just-not-as-much-as-before contract that they’ll try to force JYJ into signing. They don’t give a damn about DBSK or JYJ and so they have no problems hiding behind their lame excuses while pretending to be ‘heartbroken’ over the situation. Never mind all the unprofessional conduct of before…Only a real idiot would buy into this. That or some uniformed persons which unfortunately there seems to be a lot of.
