서울강남경찰서는 9일 화장품업체 W사가 인기 아이돌 그룹 동방신기 소속 기획사인 SM엔터테인먼트를 명예훼손과 업무방해 혐의로 고소한 사건과 관련, SM엔터테인먼트 김영민(40) 대표를 불구속 기소 의견으로 검찰에 송치했다고 밝혔다.
The Seoul Police, Kangnam Division, revealed on the 9th that that it had sent an indictment on the CEO of SM Entertainment, Youngmin Kim (40), to the Public Prosecutor’s Office in relation to the lawsuit that the cosmetics company ‘W’ has filed against SM Entertainment for defamation and obstruction of business.
김 대표는 지난해 동방신기 멤버인 영웅재중, 믹키유천, 시아준수가 그룹을 탈퇴하고 SM엔터테인먼트측을 상대로 전속계약을 끝내달라는 소송을 내자 “동방신기 멤버들의 소송은 화장품업체에 투자해 이익을 얻을 욕심 때문이었다”고 말해 W사에 의해 두 차례 고소당했다.
Ever since the three members of TVXQ—Hero Jaejoong, Micky Yoochun, Xiah Junsu—filed suit against SM Entertainment for the annulment of their long-term exclusive contract with the entertainment management company, Kim has declared, “The reason why the three members of TVXQ filed this lawsuit was to satisfy their greed for money after investing in a cosmetics company”. For these words, Kim was indicted already twice.
W 사측은 고소장에서 “김 대표가 우리회사에게 동방신기 세 멤버의 그룹 탈퇴 책임을 떠넘겨 회사 이미지에 타격을 받았다”며 “SM엔터테인먼트가 우리 회사 중국 대리점에 ‘민•형사상 제소를 하겠다’는 내용증명을 보내 보증금 반환 사태도 벌어졌다”고 밝혔다.
The representatives of ‘W’ state, “The CEO Kim is attempting transfer all responsibility and blame for the departure of the three members of TVXQ on us and this has consequently gravely damaged our corporate image”. They also added, “SM Entertainment publicly threatened our operations in China with a civil or criminal lawsuit, which has incurred further damages and led to the loss of our security deposit.”
경찰은 “동방신기 세 멤버는 장기 전속계약을 끝내달라고 소송을 낸 것이지 화장품업체 투자와는 무관하다”고 판단했다. 지난해 10월 법원은 동방신기 세 멤버가 SM엔터테인먼트를 상대로 낸 전속계약 효력정지 가처분신청을 일부 받아들였다.
이에 대해 SM 엔터테인먼트는 “우리는 이 문제로 W사 이름을 밝힌 적이 없으므로 명예훼손도 없었다”고 말했다.
The police already concluded that “the three members of TVXQ filed the lawsuit against [SM Entertainment] in order to have their long-term exclusive contract with their management company declared invalid; their legal proceedings have noghitng to do with their investment in a cosmetics company.” In October of last year, the Court upheld the preliminary injunction submitted by the three members of TVXQ to have the effects of their exclusive contract nullified during the duration of the lawsuit. SM Entertainment continues to affirm, “we have never mentioned the name ‘W’ in relation to this problem and have thus never commited defamation.”

La Police de Séoul, division de Kangnam, a révélé le 9 de ce mois qu’elle a envoyé au Ministère public une demande d’inculpation pour le PDG de SM Entertainment KIM Youngmin (40 ans) concernant le procès que la compagnie de maquillages W a intenté contre SM Entertainment pour diffamation et obstruction dans ses affaires.
Lorsque trois membres du Groupe T ont engagé une action en justice contre SM Entertainment, pour faire déclarer nul leur contrat de longue durée avec la compagnie de divertissement, Kim a déclaré que « la raison pour laquelle les membres de Groupe T leur ont intenté un procès est leur cupidité croissante après qu’ils aient investi dans une entreprise de maquillages ». Pour cela, il a été condamné deux fois.
Les représentants de W déclarent, « Le PDG KIM tente de nous faire endosser la responsabilité du départ des trois membres de groupe T de [SM] et par conséquent ceci porte gravement préjudice à l’image de notre entreprise ». Ils ont aussi révélé que « SM Entertainment a menacé publiquement nos opérations en Chine d’ ‘un procès en justice civile ou criminelle’ ce qui a entraîné la perte de notre dépôt de sécurité ».
La police a déjà conclu que « les trois membres de groupe T ont engagé un procès [contre SM] pour rendre nul leur contrat de longue durée et de nature exclusive avec leur compagnie de divertissement ; leur procès n’a rien à voir avec leur investissement dans une entreprise de maquillages ». En octobre de l’année dernière, la Cour a approuvé la demande déposée par les trois membres de groupe T de déclarer la nullité de leur contrat exclusif pendant la durée du procès. SM Entertainment continue d’affirmer « nous n’avons jamais cité le nom W en relation avec ce problème et n’avons donc pas commis de diffamation ».

maybe SM is using all to delay and delay this case. still that a case was filed against them is small victory. using that GREED word against JYJ will fire back to all who will accuse them of such. My admiration to this day, is for these 2 who has told SM they will only renew if all will be renewed. When SM didn’t agree, they left SM together. that’s pure love and brotherhood. They can’t take be happy when the other members are in difficult situation. With Eric leading them, they fought for the rights for SHINWA and won against SM. Loyalty is when you owe them a lot, but when you sweat and paid back for every penny spent on you then its business. The return on investment is even soooo much more than what’s spent. Business is business! Its is and morally & legally it shouldn’t be one sided or lopsided!

The magic word…GREED. SME is the poster child for the word. Sure, they tried their damnedest to make JYJ look like money and greed were their only motivations. Herein applies the phrase…the best defense is an offense.
Well, sometimes the offense goes a little haywire and then your game is thrown off track. Ask all those who have lost the Super Bowl game what that is all about. SME’s greed factor has led them so off course they don’t know which direction to go in…karaoke, amusements parks, cruise ships, etc.
But at the end of the day, standing at the finish line, ready to make their way over to the winners’ stands, JYJ who are bringing home the GOLD. (in more ways than one) 🙂
agree, maybe its fate for JYJ to be the instrument in fighting this. hard for JYJ and hard for us true JYJ fans. SM so powerful and connected. We don’t have much stones to throw at them. With limited ways to fight them, its good to see SM loosing in their own game:)
Ah, my sister, it is not always about throwing stones. Even though this is a war, sometimes what you have to do is make the other side use up all their ammo. Once this has been accomplished, they have nothing left to throw at you.
So, the more SME extends themselves trying to derail JYJ, the less they have for the ones who really need it, the remainder of their talents. Looking at the preview of their quarterly report which should be coming up soon, the 9th I think, there is every reason to be glad. The big bad wolf is showing signs of wear and tear.
So, since the opponent is not the sharpest knife in the drawer, when it comes time to use weapons, they will be flinging around a dull blade. Because JYJ and crew are using their brains, they are staying on target. That is why they are staying in the fight and doing a hellava lot better than anyone thought they would. 😉

long story about Shinwa….debuted in 1998, they are hot merchandise SM had during their stay with SM ..long read @ http://en.wikipedia.org/wiki/Shinhwa. They ended in court for copyrights claims to band name Shinwa which the members eventually won against SM.
