C-JeS made an announcement today (translated below) that informs the fans that it has withdrew the petitions for injunctive judgment and is now filing the Main Lawsuit against Avex. C-JeS terminated its contract with Avex regarding JYJ’s Japanese activities on February 22 of this year because Avex, by unilaterally declaring cessation of JYJ’s Japanese activities and also by not doing anything that a management company must do for its artists for over half a year, breached the contract.
Avex is arguing that this termination is invalid. Avex then did not go to court to assert its position in the proper fashion but rather used its business influence to tell a falsehood (that Avex has exclusive rights to JYJ) to the venues of JYJ’s charity concert and severely interfered with JYJ’s affairs. C-JeS therefore has decided to assert its rights in court through its Main Suit. It withdrew the petitions for injunctive judgment since the concert is mere days away.
The translation of the C-JeS announcement follows.
On the Bringing of the Lawsuit Against Avex Management Corporation
The withdrawals of the petitions for injunctive judgment that took place yesterday were withdrawals for the Main Suit. Currently Avex is arguing that the termination of its exclusive management contract with JYJ is void, and is acting to interfere with the charity event through the unfair imposition of force. At this we have decided to file the Main Suit and we plan to argue our legitimacy in the court of law.

We (“C-JeS”) have come to bring the following suit against Avex Management Corporation (“Avex”) to prohibit its interference with our management duties and such with regards to the activities of JYJ, our affiliate artists. Therefore we report to you.
As for the JYJ Tohoku Kando Earthquakes Relief Charity Event (the “Current Charity Event”), we sold the tickets having received the consent of Saitama Super Arena (“SSA”) which was the planned hosting venue. However, on the home page of SSA, an official announcement was made which read that it “decided that to give permission for use was improper.” The resulting change in venue and such led to huge inconveniences to those who purchased the tickets and also worry. We deeply apologize.
The root of the current situation is that there was a request from Avex to SSA that: “JYJ cannot be active as artists as long as they do not act through Avex. Therefore we ask that you do not give permission to use the venue for JYJ’s activities.”
However, on February 22 of this year, C-JeS terminated the exclusive contract between C-JeS and Avex with regards to JYJ (the “Current Contract”) due to Avex’s defaulting on (failing to perform) its duties. Due to this termination, Avex lost its exclusive rights to manage JYJ’s activities with regards to Japan. Therefore, the above statement that Avex made in order to keep SSA from giving C-JeS the permission to use the venue is a fabrication.
In the prior negotiations with Avex, C-JeS believed the welfare of the fans and the artist to be of foremost importance, and until now had as our goal the resolving of this conflict through consultations with Avex. However, Avex unilaterally announced the cessation of JYJ’s activities in Japan and also did not carry out its promised duties of managing JYJ in Japan for over half a year. Therefore, citing these points, C-JeS, having no other choice, terminated the Current Contract as Avex’s breach of it.
At this, Avex is currently arguing the termination of the Current Contract is invalid. On the matter of the Current Charity Event, Avex did not employ any legal means but rather interfered with it by unfairly imposing its powers, the influence inherent in a large corporation, to inform the Venue of a false fabrication to cause it to refrain from giving permission to use.
On the above acts by Avex, C-JeS, having no other choice, argued for an injunction in Tokyo District Court to request prohibition of interference from Avex and a just judgment of the court. However, because the Current Charity Event is now in front of us, as the Subject (of this Announcement) reads, we have come to decide to bring the Main Suit.
From now on, we will come to argue the legitimacy of C-JeS in court. However, we will, in the future also, consider the welfare of the fans and the artist to be foremost and do our best, such as in the holding of the Current Charity Concert. We ask for your understanding and support.

While Cjes isn’t perfect (personally I was kinda disappointed with the production value(?) of the releases thus far) JYJ definitely doesn’t seem to be in the process of being ruined to me. o.o
oh and I put faith in JYJ’s judgement (they did go against SM despite all that pressure), and since JYJ trusts cjes, I (to an extent) trust Cjes.

Would it have hurt LSM’s pocket? Not at all…he would have gotten more. Yes, no doubt it’s sure to go down in the annals of bad business decisions as one of the all time whoppers, caused by unchecked arrogance and Greed (capital G.) I find it so ironic that this company of thieves and liars had the gall to encourage OT5 fans to accuse JYJ of greed as one of the reasons they chose to go their separate ways. SM accusing these three soon-to-be ex-slaves of greed! Unbelievable.
Anyway, I think there’s one more factor in play as far as SM’s reasons for stonewalling entirely JYJ’s several pleas for a re-negotiation of some kind. The precedent it would establish will alllll the other acts SM manages. If they had been seen to be capitulating to JYJ, don’t you think every one of their other acts would have been holding midnight meetings planning their own forays into the front office? I think so. Really?? Oh, are you an attorney? So, you’ve studied both cases with SM and AVEX and this is your considered opinion then? Do you usually avoid things that are “complicated?” Those things probably give you a headache, huh? Maybe go take some aspirin and lie down for a while.
You know, there’s such a thing as laches and prescription in the court of law. There’s a certain period of time that a party can file a cause of action against another before their right to file is lost completely. The court doesn’t really look kindly upon parties who doesn’t do anything about their rights being violated for a long time and just allows the violation to continue. When that happens, the court may assume that the party is actually okay with the violation and that they consented to it, having not done anything to protest it.
No, CJeS doesn’t have to wait for the SME decision. Aside from the fact that it could arguably take a long time and the waiting would probably be detrimental to their case against Avex, the two have absolutely nothing to do with each other. Aside from the fact that there are different parties involved, CJeS’ reason for filing the main lawsuit against Avex is because they want the Court to declare that JYJ’s contract with Avex has already terminated and that Avex cannot anymore interfere with their activities, namely the charity concert (and probably others that they may do in the future). That, and because their cause of action is for ripe now – it’s the perfect time to file the suit, to be honest.
Personally, I’m glad that CJeS is taking action before Avex thinks of doing so. Better to be on the offensive than the defensive.

I think CJeS are making the right decision, sitting back and letting Avex block their Japanese activities is no good at all. For people who want them to wait until the stuff with SM is resolved, it’s been going for nearly two years and still no judgement so who’s to say there won’t be another two years? CJeS need to strike when the iron’s hot, not wait around for the Korean courts to finally make a decision and therefore give Avex time to walk all over them some more.

I am so happy things are finally starting to really clear up! Now we know for sure that the exclusive contract has expired, and Avex has no legal backing whatsoever for its despicable actions- well these have always been obvious, but now it’s crystal clear and antis, as well as some “fans” can no longer use their scare tactics to shield Avex. Saying things like Avex has the legal right to block JYJ, saying that JYJ coming to Japan without Avex permission is illegal and will lead to JYJ being prohibited from ever going to Japan again etc etc.
Thank you C-jeS for having learnt from past experience and maturing into a professional management company. Thank you Prain for doing an excellent PR job for JYJ. And thank you JYJ, for having not given up, and instead grown stronger after such a long period of unfair treatment and betrayal from allies in the past.

Yes, I believe you did, nice summary, in fact, but that still leaves my nagging question unanswered. It was: Didn’t JYJ refuse to sign the new contract that AVEX presented to them? Didn’t they walk away at that point? I’m unclear about this, I could be wrong, but that’s what I remember. So how can they be in breach? Was there an old contract with AVEX still in force?

There was a contract in existence, at the time of discussion. AVEX saw what a gold mine JYJ was, and wanted to change the terms of their contract. It had only been enforce for a couple of months before they were GREEDILY trying to change it. The negotiations started right after the Thanksgiving concert. They saw yen coming out of the wazoo. The success of that concert got them in a drunken stupor that they never came out of.
JYJ didn’t walk away from the one that was enforce, they just did not agree to the terms for the new one AVEX wanted to replace it with. Ergo, AVEX chose to ‘suspend’ the one already existing.
They just thought the guys would be dumb enough to fall for all that kumbaya nonsense, and walk right into the trap. AVEX’s big mistake – Sejong law firm is not filled with a bunch of dummies.

OK! Got it! Thank you SO much for explaining this gaping hole in my understanding of the AVEX affair. Now I think I’ve got the picture. But in any case, the original AVEX contract has expired now, the only wrinkle there being that if the Japanese court were to rule in AVEX’s favor, thy might conceivably also rule to force JYJ to continue at that time with AVEX for the remaining period of the contract. I don’t see that happening in any case–AVEX clearly breached their duties to act with best efforts on behalf of JYJ when they punitively and unfairly suspended JYJ’s activities in Japan in order to punish them for rejecting the terms of their amended contract. So honestly, I think JYJ will prevail here, just like they are going to do against SM in Korea.

Yes, it is passing strange. And it’s why I keep asking myself and anyone else who will listen to me, “What is WRONG with these great big huge Asian companies, who should absolutely know better if they are global players, who have the example of SM’s sinking ship before them at the moment for God’s sakes, what POSSESSES them not to quietly settle, behind closed doors and perhaps at some point salvage some part of their former relationship with JYJ? It’s smarter, it’s acknowledging reality. That reality being, JYJ is not your average pop entity. They are a one in a million phenomena, the exception that proves the rule, they can NOT be stopped. but is this mean that the contract didnot end and they are ending it because Avex is breaking it by halting JYJ activities?? or it did end already on the 22nd of Feb??
From the sound of it, JYJ terminated the contract with Avex due to Avex not fulfilling the terms of the contract. There is usually a standard provision in a contract for this situation. (There is one in SME’s contract, too, but it is criminally one-sided) I’m sure they did this with full consultation from their lawyers, so I’m not worried about the legalities of the situation. In fact, I’m pleased to see that C-JeS & JYJ were being pro-active in this situation and not just sitting back and letting time run out.

I’m sure C-jes/JYJ has discussed with their lawyers before taking these actions..and they must know whatever they need to know in order to go with the lawsuit..and I guess it is not an easy decision ..but JYJ’s love for their fans in Japan must be one of the reasons they come to this decision.
