After the “TVXQ crisis” that has been causing a disruption similar to a nuclear blast in the Korean music industry for the past two years occurred, a book that looks into the foundations of this case has finally been written. This book, published by EnterPost and entitled Prosper JYJ (author Kim BumTae) is now for sale.
This book looks into the ‘faceless’ singers JYJ who ‘cannot perform on music shows even if their sales are number 1’ and makes sure that the issues facing them are squarely raised. The large agencies, entertainment organizations and broadcasters, including those who have been placed in the entertainment industry as merely shareholders used to make sure the corrupt system does not collapse, have created a cartel-like structure around artists like JYJ. This book includes information from various media blogs, such as EnterPost’s popular 3 month long series “JYJ walking back to the tent”.
The title expresses not only prosperity but also a sense of fun (興, fun, pleasure, joy). It showcases the entertaining nature in which the book was written as well as a wish for prosperity and joy for those it was written for. The books starts with the background of the event that sparked the “TVXQ crisis” on July 31st 2009 when three of the five members of TVXQ; Kim Jaejoong (Hero), Park Yoochun (Micky), and Kim Junsu (Xiah); applied for an injunction to suspend their exclusive contract with their agency, SM Entertainment. After the legal dispute with SM Entertainment, and the subsequent court rulings in favor of JYJ, the Korea Federation of Popular Culture and Art (KFPCA) sent letters to various broadcast stations and entertainment programs asking for them to intentionally stop any entrance of JYJ into their programs. This was the beginning of the irrational and obvious mistreatment of JYJ in both Korea and Japan.
The book talks specifically about the case of SM hiding the truth about [JYJ’]s cosmetics business investment and using it as a source to blame for the lawsuit. Additionally the book also contains information about JYJ’s many feats—the release of their worldwide album, the entry into the Billboard charts, being the first Korean artists to hold successful solo concerts in Europe, and the outstanding musical as well as individual activities of each of the three members. Another strong point addressed is JYJ’s foreign power and how they brought the case of SM’s slave contract to light, causing a ripple among both domestic and foreign media. The book draws on various articles and cultural critics that were affected by the news and also takes a look into the hype of Hallyu.
Over the past few years the author has traveled to countries such as India, Indonesia, Taiwan, Hong Kong, China, and even Papua New Guinea in both urban and rural areas to see the local reaction to the “hot and popular” Hallyu trend.
He found that the response to Hallyu in Korea did not make sense because [people] were not allowed a healthy development of opinions that could only be caused by being exposed to criticisms and suggestions about Hallyu. In particular he talks about “the media’s arbitrary powers to exercise complete control over the information on Hallyu. The media bias clearly reveals influence from large governmental agencies or entertainment companies to maintain a certain image of The Republic of Korea’s cultural industry. Because of this the Hallyu wave is becoming more of a “distorted wave” and the current of false information hinders the public’s ability to see”. The book also discusses the “loyal gratitude” that idols must have. The author says “The companies use loyalty and gratitude as excuses to deny their stars of their rights and work them until they bleed”. These points in the book have sparked heated reactions from readers since the book’s first publication.
Readers who have read the book said “though this information for many people is new, it should not only be kept locally but should also be spread abroad”
They say that translations and publications to reach overseas fans in China, Japan, and Thailand were necessary.
The company is looking into and planning publications in Japan because of local curiosity about the investigations behind the practices restricting JYJ. “Prosper JYJ” is also republishing in Korea because of hot reactions from readers.
With readers of this book becoming more aware of the unfair and unreasonable situation surrounded JYJ, it is hoped that the entertainment industry will improve its structure. The author has said that a portion of revenues from this book will be donated to the World Vision Global Fund which aids over 100 countries worldwide with relief and development.

I think you’re being a little bit uninformed here. I also noticed that there are many BE who are still BE, in that they truly support all 5. But this I can be certain, there are more JYJ anti’s in Japan than anywhere else in the world (according to the Japanese fans I’ve talked to and Japanese youtube videos). The impacts that the lies that had been spread by Hotel Girls + the books written by Yu Kigoshi about how JYJ are greedy & heartless traitors are still felt until these days. Occasionally we would have those articles like the one recently published in Asahi. So no, I do NOT know that these kinds of tactics exist in the JYJ fandom.
And yes, @coffee craze, I think it is the utmost priority to translate this book to Japanese first.

Yes!! This book should definitely be assigned reading for all S Korean students.
It includes their European concerts? Those JUST happened! How quickly or how long ago was this book written? Otherwise, it’s too bad the only ones who will probably read it are JYJ fans. Preaching to the choir, so to speak. It sounds really good though. At the end I was thinking, they should donate a portion of the proceeds to JYJ’s legal fund, lol! ^_^

It has to be at least a year ago, if the author’s prolific, though I’m not familiar with Korea’s book publishing practices. Anyway, he could’ve submitted the chapters progressively, it would’ve been easy enough to include the European concerts that way.
And as above, I’m sure at least some non-fans would’ve bought the book too, out of curiosity if nothing else. Hope this means people are going to be more well-informed about the situation and put those HoTels out of business. 🙂

Hah, after this book, does that Asahi newspaper writer even matter? 🙂 I am so glad that the Lord is looking out for our boys. It’s only through forums that I am getting a good grasp on the wicked and twisted ins and outs of the k-music industry. These oppressors didn’t even imagine that our humble and mild-mannered boys would put their careers at risk to go against such corruption. SO PROUD OF OUR BOYS! And to the writer, may you be blessed also for writing this expose.
As much as I want to read this book, what I really want is for it to be published in Japanese. I think there must be so many fans from the old TVXQ days in Japan who would have a very different understanding if they read this.
I can’t believe that the entertainment industry in Korea has the nerve to so obviously exclude JYJ from all the entertainment shows and award shows when their album is so high on the charts. I hope this book shows the truth to everyone.

The fact that JYJ is the subject does not require permission. In most publishing situations, once you are a public figure, you are at that point subject at any time to be written about. It just depends on whether or not what is written is true and can be proven. Using their name does not require them to be compensated. But the author is apparently making a concession by donating funds to a charity JYJ also sponsors. So, it’s all good.

C-JES is the only entertainment company that uses the new system in south korea. KFPCA don’t want companies like C-JES to rise so it may have issued the collaboration in order to put the artist in line. they stated themselves thier fear that other idol or artist i forgot theword they used but they stated they fear that if JYJ win the lawsuit then others will follow and ruin something i think it was the system they were worried about it. freedom to the stars maybe i don’t get it fully. worried the money earning get truned around maybe, i am not entirely sure if its sm definitely its the money but KFPCA are lunatics they want to control something i don’t know what korean wave i think they use artist to force artist to promote korean culture , to them is isn’t about music or the money to them its korea’s image and they go wako like dictators do . its fine to promote ur cultue but not on the expense of others well being and career especially their freedom to create what they want and want to make in thier field of choice

just a point of view but i realy belive they want the system because it allows control but if that goes the money earners would turn tables then companies won’t rise to power over people : P seriously look at brodcasting companies for example they want to control it isn’t just money , its both power and money just becuase its an entertainment doesn’t mean its free of policy schools need a policy thats politics it means policy how to run something in this case how to run the music industry and just like in the past governmeants what they did is issue plocies that benefit members of government while people worked for them praised them while they also suffered under those policies and when they spoke up it ain’t fair they are suffering and want what thier right they got hostilities from the politics thier way, watch Elizabeth the people grew bitter because only a particular class got the majority of the benefits because they had the power to bully, today its the same but not with governments but companies , the companies put these policies that tame the workers and the workers go praising them while they suffer but they do this because they are powerless and the company isn’t. in modern days governments advanced in their policy system its no longer that traditional system that allowed one particular class to earn those benefits including those benefits made by others works not theirs. that’s the case now with some companies around the world in some countries even in first worlds countries some companies and agencies they try to cheat their workers and staff and only shower their supporters with the money of others because those supporters can help them and aid them in empowering the workers, cornering them in order to tame them and suck money and obedience and praise from them. that’s why KFPCA are trying to keep the old system alive by fighting the new system that frees the artist from obedience worship and making money for them. did u get what i said i don’t know how to summarize it. they find luxury in the old system they feel that luxury is threatened by the new system so they united through the Collaboration with supporters or aiders while goign hostile towards JYJ and C-JES cause they are the new system. C-JES . i just worry C-JES changes in the future if it found a chance butt hats not a nice thing to say, thats why there should be a legal system to prevent such companies like sm and jyp etc and future companies like c-jes from continuing or going back to the traditional system. but don’t anybody of u worry koreans are ademocratic country once they realise they will demand the re-enforcement of the new entertainment system KFPCA and its minion companies try to escape. they will try hard to stick to collaboration but i have a feeling the collaboration will definitely become illegal because it causes what do u call it when they don’t give small companies to grow because of someone getting everything alone so they don’t give the others a chance?? yeah hope u understood me : P
so it will take time but the collaboration will end and then more C-JES type companies can get noticed as they spread and appear which is good for any artist staff and worker : D

I do understand you. There’s hardly a country in the world where the haves don’t try and keep the status quo. The U.S. is a prime example. Those in power want to maintain it at all costs. But there is a huge difference between what goes on in SK vs. the U.S., here we have a lot more checks and balances than exist in SK.
Those who run the big companies hate regulations. As bad as things are here now, if there were no regulations at all, it would be worse. The ones who are always getting the shaft are small businesses and the vast majority of people who actually do the work. The political cycles bring conflict when there are folks in power who are definitely looking to scam the public. Just take a look at what happened here when the Bush administration went park ape over Iraq. Instead of finishing the job in Afghanistan, they jumped all over Iraq, for nothing more than the sheer desire for profiteering. All that has done is practically bring this country to her knees. It’s is going to take a lot of changes and some hard work, but it can be done.
In SK, there is so much political control by the conservatives, and the wealthy, the struggle will take more time. Folks in power don’t want to let go. But hey, look at Tunisia, Eygpt, Libya, etc, countries all around the world. It only takes a spark. This is what SK should keep in mind. There is a breaking point. Do they really want to keep growing, or do they want to implode? This is their choice, and again, choices have consequences. SK is not above being looked at with jaundiced eyes.

About the Kpop wave, are they saying that no logical person in Korea can say how distorted their “Hallyu wave” is? Wow talk about freedom of speech and expression. K media said the concert in Vegas had 20,000 in attendance and no one in Korea, even dispatch <.<, would check up on that outrageous number to see that barely 2,000 showed up, but when JYJ is being honest about their small achievement they would be the main ones trying to distort that.

There was a video that I saw on twitter. Can’t seem to find it now. But my cousin who lives in Colorado went there because she liked HM but on the first day it was almost EMPTY. Plus Johnny of AKP tweeted that they started giving free tickets on the second day because of the lack of audience on the first day.

I looked up the author, kim bum tae, and there is a twitter account with that name but i’ve no idea if that’s actually the guy…. and the publisher appears to be called Enterprise Post (엔터포스트 )…. if someone could locate this information it would be great so that we can try and contact these two to request the english translation and show them that there really is international (english) interest in the book.
For what it’s worth, this was put in the comment section on AKP in their article on the book…not sure how reliable this is. I’m having trouble locating this site in a search. Does anyone know anything about it?

Sweetie, even though nothing has been confirmed right now, I have a feeling this will eventually make it’s way into English. One of the focuses of the book aside from dealing with JYJ, is the myth of the Korean Wave. Well, that Wave is suppose to go across the world. So, to me, it stands to reason Mr. Kim wants the message to get out there. Considering the impact the author want to make, I’m going with the thought he wants the message to go as far as it can. There is mention of the international support of the guys. I’m going to keep a good thought and wait patiently. 😉

I don’t even want the english version. I want this guy and other experts to be interviewed about the horrible state of the Korean entertainment industry. There needs to be a honest talk about this problem. The system that they are trying to preserve by blocking JYJ will bring down the so called halyu wave. It is not sustainable. The time to change is now. They shouldn’t wait for their own 2008, bust of the housing bubble type of disaster. They should take steps to reform now.
Ah, but having the book available in english opens up to doors for international pressure to be put on specific parties, with the facts in hand. that’s why i want english, just ~just~ for my own education (though that’s a factor as well) but so that foreign leaders, human rights people, etc can be given the material and will understand it immediately, w/o having to fuss around with a translation. things are always easier when printed in a person’s own language 🙂

I doubt anyone will see this message buried here, but I want to give you a bit more information. This book, at present, is only for sale on Interpark’s website. It is not being sold in any of the brick-and-mortar stores or any other websites. And aside from this one story, I can’t find a single mention of this book anywhere in the media. So I think it’s safe to say the vast majority of Koreans don’t even know this book exists. The reason I’m mentioning this is because I really hope the members here will refrain from saying bad things about Koreans when the “revolution” we all hope for most likely fails to materialize. There’s a lot of things here in Korea that I don’t like, but sometimes the comments made here about Koreans really hurt me. Thank you for your consideration. ^_^

uhmm…Hello!! the lawsuit has NOT ended yet!!
as much as we would love for all this to be true the lawsuit is very much still in effect but a meditation period was requested by JYJ back in the summer and is still taking place right now. if anything the last court hearing did not indicate any positive outcome to JYJ.
i dont think this book should be released now. they are still in the middle of a serious legal battle and this could cause them further problems if SM finds it too provocative and aggressive. SM and the other companies mentioned in this book could easily file a new lawsuit for defamation.

HannieJ, in case it has escaped your notice. The district court in Seoul has decided on the contract. They said it is an unfair contract. Correction, JYJ’s law firm did not ask for mediation. The court IMPOSED forced mediation on both sides because one side was BS’ing and stonewalling. Want to take a guess as to which one it was. So, the only thing in dispute as this moment? HOW MUCH SME HAS TO PAY JYJ TO MAKE UP FOR ALL THEY STOLE FROM THEM!
This book does no harm because the decision is moot at this point. It’s already been made. Everyone who is regular on this site and on JYJFiles knows what the facts are. If you don’t believe me, check out the court decison yourself.
Also, the only way they can file a lawsuit and win…they have to be able to prove everything in it is a lie. How much do you want to bet, they don’t want to go there? You see, the burden of proof is on the person filing the claim. Besides, publishers have lawyers who go through the material to check for damaging and libelous information. The ones to be sued would be the author and the publisher. In a ‘democracy’ one should be able to speak, write, and publish as long as one is telling the truth. Can’t imagine SME and cohorts want to open that can of worms.

Actually South Korea’s defamation laws are different. Saying something that damages another’s reputation, even if it’s true, is grounds for a defamation lawsuit. I don’t fully understand it because it seems to be applied very unevenly. But basically if you write on the internet that your boss sucks and owes you money (and you identify your boss or company by name), your boss can sue you and win, even if it’s totally true. (I know someone this happened to.) This is why there are no legitimate reviews in Korea of things like restaurants or music. I know that many people have said crap things about JYJ and not been sued (and vice-versa, honestly). And I know netizens sometimes go apeshit with the things they say and don’t get sued. Don’t ask me to explain the finer points of it, LOL. I just know this basic information is true.
So basically, yes, the author of this book could potentially be sued even if everything in the book is 100% true.

I am not going to claim the information I’m providing is total and complete, but from my inquiry on Wikipedia – defamation laws in South Korea – this information was provided and it appears to be referencing ‘cyber’ defamation, which this book is not. If anyone has any additional or corrective information, it will be welcomed. So, until that happens, I am going to assert that published information is different than cyber information. If your hypothesis is correct, then the project that was done by one of the local Korean fan groups, using a ‘how to screw over your artists motive’, and I’m paraphrasing here…they would have been sued by now. Going your route, newspapers would not be able to print or make any assertions about individuals and corporations. Somehow, I don’t think this is the case. In any event, we’ll see what transpires. Again, JYJ are not part of this, they are simply the subject matter.
Republic of Korea
Korea is interesting as truth is not important with defamation; any words harming another can be considered illegal and may be punishable with fines and imprisonment. “Defamation” is covered by several laws in Korea, civil law, traditional criminal law & modern internet criminal law-under the ‘Act on Promotion of Information and Communications Network Utilization and Data Protection, etc.’ (internet and email related laws) – 2005 CHAPTER IX Article 61 (Penal Provisions) This shows defamation varies significantly from North American laws and in general by country and by case. As image and ‘public face’ is very important in East Asia, it is incredibly easy to sue for ‘loss of face’ (defamation) in Korea. Even middle school students are active with cases (Little Suzie said my son was ‘stupid’, etc.).
(1) Any person who has defamed any other person by alleging openly facts through information and communications networks [anyone stating false comments by internet and email] with the purpose of slandering him shall be subject to imprisonment with or without prison labor for not more than 3 years or by a fine not exceeding 20 million won.
(2) Any person who has defamed any other person by alleging openly false facts via information and communications networks [anyone stating true comments on the internet and email] with the purpose of slandering him/her shall be subject to imprisonment with prison labor for not more than 7 years or the suspension of disqualification for not more than 10 years, or by a fine not exceeding 50 million won [approximately US$50,000 plus since this is only criminal law, in Korea you can also sue for more damages with civil actions].
As of June 2010, cases were heard before Korean courts and individuals were fined a few thousand dollars for emailing true facts (an email stated “she admitted she was guilty” to a lawyer managing a related case). These comments were identified in email sent to foreign lawyers [considered privileged and confidential in Canada] managing a related case in Canada. True statements about a Korean individual were sent to answer questions from a Canadian lawyer and these statements were decided by Korean court to be punishable with a fine. International “comity” procedure or “intent” appear not important in Korea.[40][citation needed]

I don’t know if the law is the same in Korea, but in defamation, what the law punishes is malice. If what the writer is saying is true, then the only way he could be held liable for defamation is if it could be proven that his intention in writing it was to be malicious and that it was really his intent to ruin someone’s reputation.

@ Butterflies. No problem about the name. I figured it out. ^^ It can get pretty hard to tell who’s saying what here sometimes. But basically, the way I interpreted the passage you posted was that cyber communication is /also/ covered by these laws, not that it is the /only/ communication covered. These laws are quite old and come from “old school” thinking in which reputation is as/more important than truth. They pre-date the age of the internet. The wikipedia article’s examples are primarily cyber-crimes, I guess in order to show the breath to which the laws have been applied (such as international communication via email), and so may be a little misleading.
As I said, application seems to be uneven. But also consider that an entity that has had something crappy said about it has to show that their reputation was harmed, and thus will probably only take action if it’s a really big deal. But amongst smaller entities, yeah, they sue each other constantly over this kind of stuff. There’s also safety in numbers; if all members of the media publish a story that “defames” someone, that someone is going to have a difficult time suing all of them. But individual journalists take an enormous risk if they go out on a limb alone and publish something unflattering….which is why the media here is so uniform in what they report and why they are so willing to do things like take down “unflattering” interviews and stories about SM & its artists.
In the case of SME, in order to keep their business from collapsing, they are working very very VERY hard to “prove” they are suffering no ill effects from the departure of JYJ and its aftermath. Therefore, thus far they have not sued anyone for anything that’s been said, because in doing so they would have to acknowledge they have been hurt by it, which is counter to their interests. Yeah, SM’s reputation is terrible but they’re pretending everything is great. Their profits have dropped and their expenses have skyrocketed, but they counter this reality by magically exhibiting record high stock prices, getting high-profile financial faces (like Kookmin Bank) to publicly cheer for them, getting branches of the Korean government to financially back them, and suppressing as much news of JYJ’s success as they possibly can. If there reaches a point where SM can no longer control the news surrounding their real situation, they may start suing like crazy.
So all the efforts made by JYJ, progressive journalists, and fans are a double-edged sword. As long as SME maintains its power, everyone is safe. If SM should fall, they will try to take everyone with them and may well succeed.

Oh, I got the fact that the Wiki article was focusing on ‘cyber’ defamation. And I surely do understand, any journalist or writer who attempts to put out the truth on individuals and corporations takes a huge risk. My memory bank is dredging up the situation regarding the former president of SK who committed suicide because of a family financial scandal. All of this was brought out into the public by the media. Granted it may have had a push from the current regime, but the family to my knowledge never went after anyone.
I guess what I’m trying to say is, I find it hard to fathom that the publishers would not have known what kind of climate would result from this. Why venture forth at all? Anyhow, we’ll have to see what stance SME takes. Yes, they are always threatening to sue.
By the way, if you check out their stock situation, although it is not bad, since 11/23/11, it has dropped from 62 pts, to 45 pts. as of Friday 12/2/11. If they are trying to convince folks that losing JYJ was no big deal, they are not doing such a bang up job of it. With their 2 biggest groups barely selling better in Korea than JYJ, investors must be wondering what’s going on. Especially when they are promoting out of the wahzoo! 🙂
