As previously announced, Palm TV‘s ‘Palm News‘ aired their much-anticipated episode with claims of proof on SM Entertainment‘s obstruction of JYJ‘s activities.
On December 22nd, the broadcast stated, “SM Entertainment worked with the Korean Federation of Pop Culture and Art Industry (KFPCAI) and the Korean Entertainment Producer’s Association(KEPA) to keep JYJ from appearing on TV programs.”
Reporter Lee Sang Ho stated, “SM Entertainment is expecting a fine of around $500,000 USD to $800,000 USD within the year, which is the amount that JYJ lost by the obstruction. There is a lot of tension building around SM and the Fair Trade Commission, as the company has been trying to cut back on the costs of the fine as much as possible. The FTC’s chief, Lee Tae Hwi, has expressed that he hopes this case will be an opportunity for the entertainment industry to establish justice and order. There may be additional investigations ordered.”
The reporter then submitted documents to show that SM had worked with the KFPCAI and the KEPA to keep JYJ out of broadcast appearances. However, these documents of the KFPCAI attempting to restrict JYJ’s TV activities were already put in public light last October.
At the time, the KFPCAI and the KEPA had stated, “Due to the fact that the lawsuit surrounding the three members and SM Entertainment has yet to be resolved by the law, and since they [JYJ] have formed their own group for the release of albums and promotions, we have decided that no matter what the final judgment is, this will set an unfair precedent in the industry. As such, we have sent out letters to halt broadcast stations from allowing JYJ on their shows.”
The FTC, on the other hand, denies the claims. Speaking through OSEN, Lee Tae Hwi expressed, “We are in the process of an investigation because there has been a report of such activity, but whether or not we will take this to the committee has yet to be decided. We cannot reveal the inner details of the investigations yet, but we will take it to the committee once we judge that there were indeed illegal activities.”
Jung Hae Im, the figure that led the FTC to investigate the matter, was asked what motivated her to report it, to which she replied, “Despite the fact that JYJ had released a drama OST, digital distributors did not provide their songs and consumers had no choice but to buy the physical CD. The point of digital distribution websites are to allow consumers to purchase songs of their choice for a fee. I, however, was not able to purchase what I wanted to listen to because this method was blocked.”

Glad to see that, even though this is still ongoing, the general korean population is finally being exposed to some of the dirty laundry that SM et al are trying desperately to keep hidden in the back room. Dunno what the viewer-ship is on this news program, but the more of these that come out, the better. Newspapers, magazines, and finally broadcast media are strarting to let these little tidbits float out into the mainstream korean population. I hope that that statement about it being over within a year comes true, and YOU GO GIRL to Jung Hae Im for reporting this, though I’m hopeful that there were many others reporting as well.

This is what I’m curious about… I’ve been wondering what the general populace if Korean (even Japan) knows about the injustices being done to JYJ. Does it mean to say that international fans know more about it than native S. Korean???
Well come to think of it, you will not really research and look up on what’s happening with JYJ if you’re not a fan and since they can’t appear on TV (which has a very large influence on Korean entertainment) so maybe they really are in the dark. I hope that this news spread and get the attention of other station…

This statement just made my blood run cold. Who ARE these people??? Does anybody really know?? Do they or have they ever done anything else besides bedevil JYJ?? Ladies and Gentlemen of JYJ3–SM Entertainment is a very powerful company. If we have learned nothing else, we have learned that in the last year and a half. The question is, can they continue to subvert justice in an action that involves a hugely popular, high profile pop group who millions of Koreans want to see on TV? It’s a test case, if you will, one that will be cited in law schools in S. Korea from now on, forever. The answer to the question, S. Korea being a democratic society, would seem to be a given. Then again, when Lee Soo Man was accused, tried and convicted of stock fraud involving millions of dollars bilked from his own company, that seemed fairly cut and dried too until the PRESIDENT OF S. Korea pardoned him and he walked away scott free. So there’s always that nagging question…

Dear VE Sister, SK is a pseudo-democracy. They may advertise themselves as a true democracy but such is not the case. She has elements of a democracy but given the petulant way these chaebol operations perform – thumbing their noses – there is no comparison. I’ve seen reference to the fact that, ”they all work this way”. Well, no this is not the case. There are LIMITS to how much power companies like this in the West can pull this kind of BS off.
To be honest companies like this in the West spend more money lobbying than anything else. And yes they can wield a great deal of influence when it comes to getting legislation passed. But not so much in the legal arena, and this is where the comparison fails. Just set your memory back on some of the past perp walks of CEOs and executives of companies who went astray. They went to trial, got convicted and served time, and/or are still serving time. If dear old LSM had pulled off that nonsense here, instead of in SK, his short litlle behind would have been in prison just like Martha Stewart. And her error in judgement wasn’t anywhere near as criminal as LSM’s. The head honchos at Enron, two in prison, one died of a heart attack before his trial. And let’s not forget the fact that one of the largest accounting firms in the WORLD was forced to shutdown in lieu of prosecution, for their complicity in the Enron debacle.
LSM and cohorts better be real happy they are where they are and not here. One of the failings I see regarding SK being a ‘true’ democracy, no trial by one’s peers. This is how the ‘out’ was worked into the system. Don’t give the citizenry a voice in justice. So to those who feel there is a fair comparison, look again. NO there is no comparison. At best, SK is a pretend democracy. The press not covering the story and reporting the raid…guess again which democratic system would be TELLING everything there is to tell. Just ask News Corp. how they feel being on the receiving end in Britain over the phone hacking scandal.
Just because one uses the term democratic, doesn’t make it so. What passes for democracy in SK is a sham. To arrogantly state you are going to disregard a legal outcome and expect no legal redress, is saying you do not respect the rule of law. Try that here, Britain, or France and see how well that goes over. The only thing that will make these yahoos adhere is public opinion. The more public opinion swells up against them, the more likely the outcome will go the way it should. Seeing how the political landscape is beginning to shift, I’m banking on the good guys prevailing.
too true. there is a lack of transparency in the media. every now and then we see scandals broke out in western countries, but they were almost always SOON followed up by trials, prosecution, punishment. when News of the World phone hacking scandal was revealed, it brought the once-famous company to a screeching halt before they crashed down to the ground. we won’t see them being reported to “negotiate the terms of fine” with the said prosecutors!!

We would all get sleepless nights if we think about the intricacies of this case. I believe however, that all these crap would soon catch up with sme. I am just glad our boys are out of sm and can sleep soundly at night. SM may be rich but he can’t bring any of those when he goes to hell :). Am sure there are also sm talents who balk at the thought that they are working for a sucker like sm but can’t do anything about it. An off-topic note, with all these news coming out, am just wondering how homin feels about this. JYJ is slowly beginning to see the light at the end of the tunnel and it’s getting obvious how sick and nasty sm is.
