The final sentencing between SM entertainment (hereinafter called SM) and JYJ’s exclusive contract dispute has been postponed again.
The final sentence for the case between SM and JYJ is scheduled to take place on Sep 13, 10 am at the Seoul Central District Court in Dongguan. But the judge had ordered that the position must be adjusted on both sides. Representatives of SM and JYJ has submitted a written note on the 11th. On the 12th, the date change was determined.
SM and JYJ’s dispute is originally scheduled last July 19. Then was changed to August 10 but SM side requested for arbitration, but eventually, the arbitration has not been successful.
There are a total of 6 arbitrations since May of last year, both sides’ position show no signs of agreement.
Last July 2009, JYJ members Kim Jaejoong, Park Yoochun, Kim Junsu who were members of TVXQ (a group under SM) has filed for injunction on the suspension of their exclusive contracts.

That’s the way it looks to me. So if it’s NOT true, then the judge needs to re-think his position. Because barring that, his reputation as a fair and independent officer of the court is SHOT.
Clearly this judge does not want to have to make this decision. He must know that he will lose his job if he sides with JYJ and he cannot find any grounds to not side with them. Otherwise he must have some incentive to stall this as long as possible. Show a little backbone.

The South Korean legal system has a serious disconnect with the term ‘justice’. If you announce something as ‘final’, then stick to it. The judicial system in SK is a joke. As long as it continues to show it has no backbone, then no one can take it seriously. How sad.
Major players on the world scene do not conduct themselves in this wishy washy manner. Trying to make parties who are not going to agree, agree is the ultimate in not dealing with reality. There is supposed to be a remedy for those who persue justice. What this judicial system is showing is that it does not give a hoot about justice. They only want to avoid doing what is right.
A judge is supposed to be able to make a determination and announce it. Your honor, you have all the facts in front of you. Now all you need to do is use your backbone and exercise your duty. If you didn’t want to engage this way, why aspire to being a judge in the first place?
The members of JYJ, who are tax paying citizens deserve better than this from their judicial system and country.

I think that it wants to delay an outcome that will be politically and financially disadvantageous for the fat cats with a vested interest. This is the POLAR OPPOSITE of what justice is. This is nothing but corruption and just like a corpse found rotting in the sun, it STINKS to high heaven.
But delaying the inevitable is ludicrous. They and the whole world knows SM is not going to make a fair and just offer. We know the system is corrupt. Well, I certainly would hope that we international fans will raise an alarm about this. I am certainly not cowed about speaking out pointedly against SM as so many seem to be. Because now, my friends, we are seeing the TRUE FACE of SM Entertainment. All day long I have been reading different boards on this situation and I would say that they are 99% shocked and angry about this pointless further delay, no matter which side they happen to be on. But SM doesn’t care about that. They don’t care about the fans, they don’t care about public opinion, they don’t care about anything but their own greedy and punitive agenda. They ARE exactly like the mafia. They function in exactly the same way.

I believe the reference is to how much the financial settlement should be from the perspective of each side. As long as the judge decides to play this game and not shoulder the responsibility he is chaged with, this will go on.

It’s so frustrating, but in no way am I surprised this happened given the history of these last-minute delays. The ridiculousness of the how the court has handled this case is incredible. All I know is I will steadfastly continue to stand beside JYJ.

I think that “the position” is THE MONEY. As butterfliesarefree said, this last part of the lawsuit is all about money and how much SM must pay JYJ. It also apparently makes final all of the earlier rulings that are now temporarily in place about JYJ’s right to conduct business unobstructed in any way they choose, which at this point is little more than a sad, not-very-funny joke. But the court has been willfully blind to this fact and has chosen not to hold SM accountable to the law.
So I guess what the court is saying is “SM you have to offer more money and JYJ, you have to ask for less money.” Now WHAT this has to do with rendering a final verdict in this case where 5 or 6 attempts at arbitration have already failed is BEYOND ME. But it is an unpleasant coincidence that all of SM’s artists were JUST recalled from Japan and must now promote their new product in SKorea only. Could SM be once more assuring itself of an uneven playing field??

@lilibaiyu ~ Thanks for the explanation, I definitely agree that this could be about the money. Actually that was my initial thought, and this may be me needing to brush up on my knowledge regarding the legal system, even more so the SK legal system, but I read the notice and wondered why (as you mentioned above) the reading of the final verdict is stipulated by the parties coming to an agreement on the money.
To me, it seems like it would be the judge’s duty to look at the circumstances/case and render an appropriate amount or at least to determine that the positions of the parties needed to be adjusted much further in advance of the scheduled ruling. All of this just gives further evidence (if any more was needed) that “justice” seems to be an very abstract concept in this system.

There is a huge backlash of anti-Korean sentiment there now which has affected SM artists because of comments made by one of them regarding the controversy over an island’s home country currently in dispute. (I forget the 2 names of it but one is Korean and one is Japanese.) Since many Japanese are fed up with the Hallyu Wave anyway, it became an issue.

Actually, the drop in stocks is not that bad. They have been making a climb. They were in the mid 40’s range earlier in the year. SME stocks flucuate on a cyclical basis. When the issue with JYJ leaving was at it’s zenith, they had some serious drops. But SM also manipulates well, so the integrity of it’s numbers can be suspect. But this % decline is not that unusal. If it goes down below the 50 pt range again, then there should be some serious attention paid.
The important part of the health of the company are the figures given during the financial reporting for the upcoming quarters, and YE numbers. Then compare them to what they were the year before. This won’t happen until the first quarter of 2013.

One of the very interesting pieces of the puzzle regarding the posting of the SM stock page on Bloomberg…there are never any articles related to the company business. I go and check it from time to time, along with AVEX’s. Now I’m not sure how the service obtains its articles, but none for SME? Too much secrecy is a very telling thing.
Yes, it is entirely possible their subsidiaries are possible drains. What I’ve thought is they acquire so many to make themselves look like they are growing wisely. My mind keeps playing back the comment made by the CEO KYM about shifting their focus to digital sales vs. hardcopy cds. Lower production costs anyone? And fewer promotional costs? If the recent comment is true that their premier artists are not selling as reported….well. Also, their now extended reach into the Chinese market, as if they had a clue that Japan would soon become an unwelcoming landscape.
There is nothing wrong with diversification, it helps spread the risk. But one can grow too fast as well. Ask any number of U.S. companies over the past decade who have fallen on lean times. Not to mention the fact that their training system is probably their biggest drain. The format is not worth it. Even if the other 2 biggies have training setups, I would guess their’s are not anywhere as extensive as SM’s, therefore, not anywhere as problematic.
Regarding Sejong, JYJ’s law firm, I wouldn’t question their tactics too much. As I’ve said before, this is the law firm that used SM as their best witness for JYJ’s case. They let SM shoot themselves in the foot on more than one occasion. It was almost like taking candy from a baby. Lawyers can be a very tricky bunch. Just when you think they are playing it too safe, they come and jump out at you scaring the bejeezus out of you. My money is still on them. This tactic is kind of like giving SM enough rope to hang themselves.
It’s frustrating to us because we want this over with, RIGHT NOW! 🙂 The one thing Sejong cannot control is the court’s lack of intestinal fortitude — GUTS. But look at it this way. Ultimately, SM is going to have to pay JYJ. The longer the court lets this become a waiting game, the more this damages SM’s image. They appear to be more and more like obstructionists, petty and spiteful. It doesn’t make the Hallyu Wave look to nice.

This sinister company has demanded and covertly enforced an industry wide boycott through threats and intimidation of TV stations, concert venues, music charts, CD manufacturers and print media among many others for over two years now even though the High Court in Seoul ruled long ago that the members of JYJ were free to go about conducting their activities unhampered and unimpeded by outside influence. SM has flouted this ruling repeatedly and so far with impunity. No one seems willing or able to stop their law-breaking vendetta to end the careers of JYJ. There are no finer examples of hard work, great talent and determination to succeed in S. Korea today than these exemplary young men, Kim Junsu, Kim Jaejoong and Park Yuchun. They are a great credit to their homeland and have always been willing to promote the interests of their country as ambassadors of good will. As you know, in addition to a devoted fanbase at home, they have a huge and growing fandom internationally, with no end in sight. Isn’t it a terrible shame then, and certainly a blight on the reputation of S. Korea’s democracy for JYJ to be banned from ever appearing on TV in their own country by this criminal organization, SM Entertainment, who goes about flouting the law and attempting to ruin them time and time again?
We have just learned that the Seoul District Court has posponed indefinitely a reading of its verdict in the final case of JYJ vs SME in favor of mandatory arbitration between the two sides. There will be no end to this trial because the two sides cannot agree on a compensation amount for JYJ.
Something MUST be done here. Someone must act to end this terrible stalemate where only one side suffers – JYJ.

I know something about law and all I can say is that this is becoming ridiculous… If both parties can’t do it themselves than the judge should take the dicision, that’s how it goes. Companies that don’t have fair labor practice and don’t pay their employees their due wages are probably not paying enough taxes either. The government agencies like the bureau of internal revenue and department of labor should look into this matter too.

And also yes, SME probably pulled all its artists because of the Jp/SK dispute about the govt issue around the island. TVXQ stands a chance of being in the end of the year awards, since its been noted they are not truly “considered” a Korean act (yes, even though they are Koreans) because of them starting from the ground up and learning the Jp language, etc.

iThe article should mentioned that those arbitration was pleaded by SM, so people can see that SM themselves tried to delaying numerous time n tried to avoiding the court make a verdict by doing that, that’s why they keep hoping for settlement OUTSIDE the court. i was already mad like crazy when SM keep trying to prolonged the trial by not submitting their accounting reports, but now, its the JUDGE himslef who delayed the verdict. why must he did that? he supposed to be fair, not to be concern with big company. at first i thought because this kind of case is really sensitive, since it will changed ent industries in SK. But, by now not only JYJ who have lawsuit against their company. Hankyung, Ivy, and even Park Jung Min from SS501 are suing their company, and more or less have some similarities with JYJ. Even PJM was sued his company n ask for cancellation of contract coz the company didn’t pay him for his work, and SM PROVEN didn’t pay bonus and the boys’ pay for any concert activites the did. Hankyung, Ivy and Park Jung Min’s cases have ended with verdict after more or less a year from their 1st court date. They have won. So I don’t think if SM lose it will make huge changed like many were so afraid for. Other artists have done what JYJ did without even the verdict. SM have lost 2 times over JYJ. They lost against Hankyung and also many times to other artists too. LSM even have been sentenced guilty n supposed to be jailed before he granted presidential pardon.
So why the Judge keep delaying the verdict? It was weird enough he granted SM’s 5th arbitration after all 4 SM’s arbitration plea was rejected before. And the Judge always announced the postponing A DAY BEFORE THE VERDICT DATE!!! It was like after the whole proves have been shown, testimonials have been given, even after SM founded guilty for broken court order, the Judge seems so reluctant to give out the verdict. And by announce the delay just a day before he supposed to be give out verdict, just make him seems he CANT make a verdict, thus he keep postponing it.

There were more than 3 court hearing, there were even 2 under him (after he appointed for the case replacing the other judge). Verdict date mean you should give out a verdict, and not to ask them to ‘adjusted’ their position. What need to be adjusted? JYJ’s position is they want no relation with SM again. SM’s position is to breaking n destroying JYJ AND they are also a law breaker. Gosh.. i am so mad!!!

Justice….Fairness under the Law….Wasn’t it Junsu who not long ago tweeted that he had given up on fairness some time agoT_T! To me it is slow torture of three innocent and hard working young men by their own country’s “judicial system”, a country they dearly love. No fair minded person who believes in the rule of law for all citizens and fairness for its nation’s greatest artists can do anything but deplore this latest act of shameful stalling by SM Entertainment. The International fans of JYJ call upon all of the world’s people to boycott SM, their stock, their artists and all product they produce in protest of this blatantly obvious ploy to further delay justice for JYJ. End this lawsuit NOW! The International community is watching what is going on in S.Korea and its compromised justice system and we are appalled!

But seriously as someone studying commercial law, I’m pretty sure all my course mates can do better than the judge at determining legally material facts and come to a conclusion based on legal principles better than the SK judge. Maybe it’s time for them to go back to school again and re-learn evaluation and critical analysis skills. And their legal needs a major revamp big time.
They seems to be trying to make JYJ lose their fighting spirit with all this delay… so they can pay JYJ what they want, and they can make JYJ do what they want…

The day coming back to music and reality show (: it seems so far away to JYJ. No matter what they try, they’ll unable to escape SM’s game. SM manipulates the whole system and plays dirty tricks behind JYJ’s back in order to stop JYJ’s success. We can’t use words to describe how terrible SM’s but I really disappointed the Korean legal system. SM can even control the legal system??? Why they do whatever they want without any punishment??? Korea have the laws just for doing for fun and encourage people like SM to break it??? I feel so pity for JYJ (: they’re suffering more than I thought. How can they survive under this kind of society and this kind of people like SM. I know fairness is never reaching to JYJ, but it’s too much for them to be able to handle.

Seoul central court, to me is not a lower court like labor tribunal, nor a small claim tribunal . The court charges are higher and can rule heavier sentence.
Ask the weaker side to ” discuss” more with the stronger side, for heaven sake!
People working in legal fields, have known each others wekk since university. And perhaps with apprenticeship relationship. For JYJ legal rep, obviously not wanting to
irritate the judge. But this case , they need to boldly put pressure against SM.

Seriously, though, I think the court is getting pressure to make sure that the settlement is not made public. If everyone knew how much JYJ was cheated out of there could be serious damage to SME’s–and the industry’s–reputation as a viable business. When the only way a company makes money is by cheating their suppliers (which is what the artists are — the people supplying the product SME sells), then there is something wrong with their business model. I hope JYJ holds firm and is willing to wait this out as long as it takes. Even if it means my champagne goes bad in the meantime.

Eliza, even if that is the case, again I say…some enterprising internet sleuth will find it out anyway and this would be all for naught. A complete waste of time. All this is doing is tainting the image they have of passing as a ‘justice’ system.
Besides, they knew once the contract was labelled ‘subjugating’, the gig was up. Everyone knew SM had lost. Delaying paying the guys only makes all these ‘decision makers’ look like a bunch of wussies. How does one hold you in high esteem once that label is tagged on you?

And I get your point that SM’s actions are as much cautionary measures of further clamping down on all of their other highly successful artists lest they too get the idea of leaving, suing and asking for THEIR rightful share of artist’s royalties. SM needs to make it look as awful and as hopeless as possible for as long as possible.
My happy daydream for today involved Homin gathering their courage and walking into the president’s office and saying “Settle the lawsuit now, end the boycott, let JYJ go without further harassment or WE’RE leaving too.” Wouldn’t that be spectacular? And no, I’m not going to hold my breath….

to be honest i am not surprise at all of this kind news…i guess i already used this situation now……i am not gonna yelled or shout about those worthless people because i won’t used my worthy time and life to think about those bunch corrupt and heartless people, I already said this many times and i never gonna stop to said it though. I am really proud to our boys and these long journey really hard yet so full with a precious moment.
Like i said before, i am gonna support and observe every project that our boys done only and I am gonna take a positive mind of this matter, i guess God still wanna give our boys time for grown up and explore every aspect in their life, keep their heart, mind and soul on their humble way, appreciate every thing that they have, learn more about life, and I love it.
No matter what those useless people gonna do for bring our boys down, i believe these boys gonna through it like before ( same goes with us). Let’s wait and see how these boys grown up more and what they are gonna be in the future shall we ?.
Beside no matter how those people wanna tried to cover up the justice and truth with a dirty way, it’s never work completely. It’s so sad that there’s another delay. I’m still on my knees praying for a sweet satisfying decision in favor of JYJ David against SM Goliath. It’s such a super grave injustice against the JYJ guys but God is still on His throne all will be well in the end. Perhaps we should donate an abacus to be delivered in the sala of the judge where the case is being deliberated to help them calculate faster. I am pissed off with SM, but I am even madder at the district court for letting SM run the show for 2 years! When will this stop? Does justice even have meaning anymore? Wow! That’s fantastic. We really are going to have to rouse the fans and make some noise, but I think we can do it. I’ve also been posting very short little blurbs on Facebook on any page that features K-Pop, and there are quite a few of them. But there again, the more “Likes” and comments we get the better, so people familiar with Facebook, please take note. Pretty much any page with “Korea” in the title is going to feature K-Pop, some more than others. But that tells you that the Hallyu Wave is a VERY important component in SK’s will to promote itself and its economy. That means that if enough of us start agitating publicly, it may prove embarrassing enough for them to actually DO something back home.

Looking at the photo on top, that is from 2010. The lawsuit had already been going for a long time. But look how young they look. It has been 3 years already since the lawsuit was filed. Are we going to see them as 40 year olds and still have the delay in reaching a decision? For them it is so pitiful. But I will still be supporting them, no matter what.
