If I had to take a guess, I’d say yes there will be an unbiased decision with no colossally transparent stalling tactics. Japan is not S.Korea. What’s going on in S. Korea is rather a unique situation considering that they are trying to hard to become a power player in the world of modern capitalist democracies. Plunked down in the middle of ultra modern Seoul is SME, a business that would be right at home in the mountainous regions of Sicily of the early 20th century, where the mafia ran the show and everybody knew it.
I hope the court system in Japan can render a fair decision in the JYJ – AVEX case. If they do, I think JYJ will probably win.

Today, I’ve watched the latest Running Man Ep115, Homin is their guest…They even played “Hug” song for their BGM..Suddenly I just wanna cry coz “Hug” is their debut song if I’m not mistaken..I really miss to see them being together in 5 even though i know it’s impossible but it’s unfair for JYJ who can’t appear in variety show T_____T

It’s 3 month from now…..a lot can happen within these months… So I will actually believe that this is over when the court actually make the final verdict or judgment… 🙂
I wonder when this will end. I was thinking if they eventually win the lawsuit, will the broadcast stations still ban them? I heard that actually jyj will forever be ban in TV stations because now it not Sm ent who is the only party that is controlling this. It become a while kpop music affair and just right, jyj is used as an example to punish those idols who have the intention of leaving the company that ” look this is what you get when you terminate you’re contract”
But it ok, this will only make me like jyj more. Glad that beside TV media, we have other channels to see jyj perform.
i sometimes also think that if jyj win the lawsuit especially in korea. did them really be able to be broadcast?? deep inside my heart i think it is quite impossible..jyj being bully among all tv station not just because of sm..i think all idol company entertainment did pressuring tv broadcast to ban jyj..yes they want to show that to all idol group this is what you got if you betray your company (sorry i have to use word ‘betray’ here)..
or in the other word if jyj win their case and at the same time also success in broadcasting it will be great pressure to all music entertainment since jyj will become one of those example that will be followed by their hoobae..

As frustrating as the ban is, as the endless waiting is, let’s always keep in mind that JYJ and members are doing just FINE these days. They are enjoying great success and massive popularity everywhere they go. Each of them individually are now superstars of SK and beyond. Together of course, they are simply magic, their fame only growing as time goes by. Needless to say they are making many many times more income than they were making as the top Idol group SM ever produced at the height of their popularity and they’re doing it all THEIR way, at their discretion, choosing their own projects and schedules. They don’t have to do anything they don’t want to, go anywhere they don’t want to or take projects or record songs they don’t like. Their very existence today proves the great flaw of the Idol System that SM touts as their trade secret for manufacturing young stars of tomorrow. It shows clearly that it’s all a ploy to sign young talented kids to maximum position contracts for the life of their career as a pop star.
This is what is so threatening about JYJ. They clearly show what a truly talented artist can achieve when they are free. The big entertainment companies who treat their young hopefuls like circus animals of course want to shut them down and show their own signees that only terrible things await them if they try to jump ship. JYJ’s every waking minute where they are before the public, promoting new projects, new music, new concert tours demonstrate in technicolor what a lie this is.
We will continue to fight to lift the ban because as fans, friends and interested observers that’s what each and every one of us should do. But let’s know in our hearts one thing: nothing….NOTHING can or will ever stop JYJ.

I don’t know what they’re trying to achieve though. I’m not sure what people in SK think, but more and more people outside their country are now disgusted with their dirty little tricks. I can’t even bring myself to muster any form of respect for them. Petty and cowardly, that’s what they come off to me. Get yourself together. If JYJ was so horrible, prove that you can ‘produce’ something just as good as them, or even better that they’ll win over the trio blindfolded, no tricks necessary. All the silly efforts they put into boycotting them only illustrated just how threatened they felt, and I can’t think of anything lamer than that, especially a lot of the shits they’ve done to the five during their years under SME.
Everyone I know that has knowledge of the lawsuit find it pathetic. And it’s sad that I can’t even think of a better word than that.
And to think their carefully cultivated, cookie-cutter groups can ever trounce the phenomenal group they lost is … I don’t know. That might be a little biased, but that’s the impression most groups left me with these days. I have never been fond of these kpop groups, and DBSK had been a delightful exception. I’ve always felt like SME got lucky with DBSK. It’s true that they had trained them hard and that of course, should be taken into consideration when it comes to evaluating their achievement. But their talents… Until today I have yet to find a group comparable to them.

Yes, I know. It is vastly frustrating, trying to figure out the Korean mindset as it relates to JYJ. My best guess is that they take them for granted, first of all, they don’t value them because they are home-town boys and last but not least they are sick of hearing about a lawsuit that will not end. I went into this fight convinced that there had been some sort of suppression of the facts, of news of JYJ’s plight in this lawsuit – that if people on the ground in S. Korea only knew the facts they would rise up in a great wave of protest. As I did more and more research into the case, I found the opposite to be true. There was loads of press regarding the case at every stage. People in SK were kept informed of exactly what was going on, including all tangents of SM’s wrongdoing in general.
So why did they drop the ball? Why did they stop caring and turn their backs on what happens to JYJ? That’s the question.
A possible answer: They are a pop group and arguably there are more important things to worry about. Also, there has been a massive SM propaganda campaign going on — even a re-branding to make SM look like the undisputed leaders of the global dominance of the Hallyu Wave. For a country laboring vigorously but fairly anonymously in the global worldview, an SK company that could instantly catapult therm into such a spotlight was heady stuff.
And SM is powerful and they have a phalanx of full-time employees whose job it is to disparage JYJ and to encourage others to shun them at the risk of displeasing SM, seen to be the newest power player in high profile SK. A large majority of SK citizens certainly weren’t going to upset THAT apple cart.

I think Japan is different. The courts in Korea seem to be as weak as a 1 month baby but some organizations have stood up to Avex in a way none have dared to try in Korea against SME/KBS etc. We can only wait and see.

It would be too much like right for the SK decision to come down before the Japanese one. Wonder if the SK courts will look at this and say, WOW they – the Japanese – will reach their decision before ours. Can’t let that happen. A girl can dream can’t she? 🙂

Well, ladies, it looks like we were correct in our analysis of the situation. 🙂 And now I’ll float a new theory – the announcement of the verdict in Japan was as distant as it was (3 months! Come on!) perhaps in order to allow the parties a bit more time to reach another closed door settlement. I don’t know if arbitration is as beloved a form of settling civil cases in Japan as it is in S Korea but it certainly seems plausible. Then AVEX gets to save face and JYJ get to go their own way, as in SK.

Not having the same amount of info regarding how the Japanese legal sysem works vs. SK, I feel as if there really isn’t much left of Avex’s case. I get the feeling they simply put more obstacles out there as a way for JYJ to use up more money in legal fees. But little do they know the fighting spirit of these guys. The members of JYJ are not going to just lay down an be doormats.
SM really didn’t have a choice, they needed a resolution and fast! So, if Max isn’t dumber than dirt, he’ll figure out the same thing. Their stock price hasn’t jumped to high either. It’s only about 1,000+ price/share more than it was this time last year. It’s over the 1,000K mark and hovered about the 9,000s for almost a year. So, there really isn’t in percentage in them hanging on and wasting their money either. One way or another, JYJ is going to be back in Japan and resume where they left off after a-Nation 2010.

what’s the court related with avex? their contract with avex has ended… no? i don’t know what is their contract with avex about? didn’t avex still want to work with jyj but refuse to work with cjes back then? but when jyj signed with avex before, aren’t they already managed by cjes? or not? if it’s so, then avex is the one damaging the contract, no? i guess it’s not about their contract…? i don’t get it… or is it about avex’s oppression to jyj’s activities in japan?

I don’t think the contract is so much ended as about to be nullified due to AVEX’s failure to render professional services and represent the boys to the best of their abilities. I’m pretty sure that when AVEX “suspended activities” they feel the clock stopped running on their contract. Once again, the boys were placed in limbo. But let’s affirm for an early settlement by the 2 sides in advance of the January court date when a verdict will be rendered. Settling behind closed doors with the terms undisclosed to the media is the way all civilized people who are in the music business handle these things, btw. The fact that these 2 cases (SME’s and AVEX’s) have dragged on this long is punitive, vindictive and WRONG.
