To the people that follow the Japanese Lawsuit, AVEX have pointed the exclusive contract of SM and JYJ as a reason why JYJ is unable to hold activities in Japan, but with the recent news of SM releasing JYJ of any exclusive contract, we think AVEX is running out of arguments to defend their position. Hopefully things will improve in Japan despite what it says on this article.
On 28th Nov, the 3 members of Korean Idol Group JYJ and its former agency SM Entertainment (“SM”) reached court settlement in Korea on the dispute of exclusive agency contracts.
Jaejoong (26), Yuchun (26) and Junsu, 3 former members of Korean group Tohoshinki, applied for temporary injunction in July 2009 on their exclusive agency contracts based on the reasons that their 14-year contract was too long and there was unfair royalty distribution.
In addition, in April 2010, the 3 members sign-on a newly setup agency and formed JYJ. This means wishes of fans for the “5 to re-group” again became in vain, and the group split up to become Tohoshinki with Yunho (26) and Changmin (24), and JYJ.
It’s been 3 years 4 months after the temporary injunction which started it all. With the court settlement this time, all law suits between SM and JYJ had been withdrawn, and both parties signed an agreement to “not interfere with each other’s activities”.
A Korean entertainment industry person talks about the future JYJ.
[Firstly, until now every media in Korea had shut off JYJ based on the “double contracts issue with SM”, leading to the members unwilling ventures into individual acting activities like drama and musical. The court settlement this time signals a complete separation between SM and JYJ, and although Junsu has dreamed of standing on stage as Tohoshinki again, the possibility of 5 members grouping-up again disappeared. However from now, the 3 members JYJ will be able to hold concert activities and TV appearances as JYJ. Of course, it will also be possible to release new songs]
If this is true, their activities in Japan will be something to look forward to. However, it’s a bit complicated.

In actual fact, events planned by JYJ last year in Japan faced cancellations right before the scheduled dates continuously. The court decision will be out in January next year, but there is high possibility for an appeal. The trial looks likely to drag on. It may not be possible for JYJ to hold activities in Japan for the next few years until this is settled.

When i used to live in the Philippines, my parents told me to never believe what i read in tabloid newspapers as they’re all crap. I feel sad for the Japanese fans to have read those bullcrap. It gets better everyday, JYJ will stay strong we all know that. So let’s all be positive! 🙂

Avex has NO reason whatsoever to cockblock them anymore…They can’t even use the SM case as evidence. They’ve got an Avex artist who’s been doing drugs/marijuana….But they do nothing about that….Instead they just affiliate JYJ with the mafia/yakuza to many of the public in Japan. =_= I seriously wish for JYJ to sing in Japanese SFM + to see them in Dome concerts again. Their “The…” is still my favorite album.

–> Nope. Yoochun and Jaejoong have been enjoying acting and are doing very well with Jae even in the movies. So is Junsu who is sweeping the musical scene. Unwilling? Unlikely.

With the lawsuit against ShittyMonster out of the way, Avex-idiot really doesnt have a lot of chips to bargain now.
They had always taken the contract with ShittyMonster and the mafia thingy as excuses to block JYJ but their grounds are shaking.
Let’s see how long they can do this when it’s also obvious that like their ‘buddy’, the shittymonster, they are taking a direct road downwards.
Anyway, this reporter really should do more homework than this.

No worries, I know our Lord will pave the way for our JYJ boys for Japan . AVEX will settle the lawsuit very soon just like SME with JYJ as they do not have much to block them now. So just wait a little longer and watch what will happen. I believed strongly 2013 will be a great year for JYJ and they will be free from all lawsuits. Always Keep The Faith!

I’m seeing things a bit differently than you but I agree that without actions you can’t expect results.
I mean no disrespect to the religious people who visit this site. Praying is a form of keeping important people and things in one’s thoughts and connecting to God but I am of the belief that action combined with faith (in the case of some, prayer) is far more helpful than just prayer and good thoughts.
I fully agree with you that actions are absolutely necessary but you may wanna be more tactful when commenting instead of bluntly calling names, Ms Anonymous.
Further, I don’t know if you’ve been keeping up with the JYJ fandom but there are many things that the JYJ fans did do, so more than a “crippled fandom” as you call it, we are doing our best to support and fight for JYJ.

@Anonymous makes me wonder.. if you knew all along about freemuse thing you’ve been pushing and it seems you know it well for some time now.. to whom (aside from JYJ3) have you told this? or have you coordinated this? have you coordinated with fangroups to inform them first without the mocking tone? (the tact is important because you talk to people of various culture .. you have to respect at least the way people communicate for them to listen to you) .. that’s what a concern JYJ fan would have done.. its not purely your attitude that we are targeting.. its the fact that you are accusing the fandom of not doing what you expect them to do and thinking that supporting JYJ in the ways they know is subject to judgement.. anyways..will send your suggestion to this group working to get JYJ on public broadcast.. they are called StandUpforJYJ and see what can be done. Piece of advise.. even how good your intention is if you dont communicate it properly no one would be able to hear.. if its normal for your language to be like that.. just think that not everyone will get your message because not everyone share the same culture as you. As a news site, if you want credibility, you’d better quote someone with an actual name and position you know? Not just a nameless, faceless “Korean entertainment industry person” who thinks they can talk about the future of JYJ.

JYJ has never had a double contracts issue with SM. JYJ’s contract with CJES is legal and SM couldn’t anything about it. TV stations only use the lawsuit as a lame excuse to block JYJ. The members have done what they want to do as all-round artists. Looking at their achievements and reading their interviews, it’s ridiculous to even think they’re unwilling.

Any dispute will come to an end eventually. Nothing is impossible, JYJ have proven that much. We’ll see what is going on in court in Jan, but Avex doesn’t seem to have many things to use against JYJ in the attempt to hinder their activities in Japan.

don’t they think their people in Japan is spending way more than they supposed to? It would be easier to let go of the ban & let the fans see them in “Japan,” rather than catch a plane every time to a JYJ event “overseas,” it be in South Korea or China…it seems AVEX is only thinking about themselves & not the effects on their own Japanese people (fans of JYJ). They love JYJ (even I understand why they go to lengths to see JYJ), but the inconvenience should be not overlooked by AVEX…just food for thought.

I’m surprised that they managed to sound somewhat civil even if a good deal of this information is bullshit.
I’ll take the admins’ advice and reserve judgment until the court reaches a decision.
I am not too familiar with the Japanese lawsuit but it appears that the leg the avex is depending on ( the exclusivity contract of JYJ to SM) no longer exists so the decision of the court this January will be moot and academic in favor of JYJ except if there are other principal issues involve. But for me the Avex case is just an offshoot of the SM case and since the latter has already been settled then what is the reason the agony of waiting be prolonged? Is it about the yakuza involvement or the cosmetic contract or are they just confusing the fans? For me the truth shall make JYJ free… year 2013 will be JYJ year in Japan. Cheers! These Korean entertainment companies need to be thoroughly investigated regarding their questionable business practices. It is absolutely shameful what they get away with. I keep waiting for the police or undercover law enforcement to storm their offices and confiscate their business ledgers, expose their fraudulent contracts and scrutinize their financial records. I cannot believe this has been going on for so long. The whole entertainment structure needs to be overhauled for the sake of future performers.
If they are politically well-entrenched it will be almost impossible to break down their walls…perhaps an act of God can do it.
