It was confirmed belatedly that popular idol group JYJ (Park Yuchun Kim Junsu Kim Jaejoong) filed a lawsuit against a domestic publishing house. For violation of publicity rights, a lawsuit was raised against Publisher A who used their photos without permission.
According to court records, JYJ members Park Yuchun (27), Kim Junsu (26), Kim Jaejoong (27) has filed a lawsuit in Sep 2012 against Publisher A for using their photos without permission and are asking for 40M KRW for damages.
The court in response said, “JYJ’s justification of the payment has been deemed lawful” But the publisher side has raised an objection, hence the litigation is still on going.
Publisher A, who specializes in entertainment magazines, has featured photos of JYJ members on the cover of the magazine. C-JeS entertainment has confirmed its unauthorized distribution and has asked the publisher to stop the sale and shipment of the product, but the publisher reportedly did not respond.
For the agency side, the publisher has violated publicity rights, so they filed a lawsuit to claim for damages which has now become a legal battle.
There is a recent growing trend of infringement cases filed by celebrities.
JYJ has a tough stance on rights infringement issues. Agency told Star news that, “The current situation is that this company A is bankrupt and we will act accordingly. But we will pursue with legal actions if such incidents occur again.”

C-JeS said it’s okay to use photos for news or press releases but these magazines have published multiple A4 size* photos which is an infringement of publicity rights. These publishers also print a special edition magazine full of JYJ photos that is separate from the main magazine itself.
*A4 is the size of JYJ bromides for con goods.

No they shouldnt back off. I come from a business family so I know how bankruptcy works. Sometimes its fake, just to get out of the hefty payout but in case if its real then the owners have to declare their assets to the bank and they will auction it off to pay for the loans, debts, etc. JYJ should go ahead with the sue because if they dont, other publishers may take it lightly and may get tempted to do copyright infrigements
If they are brave/stupid enough to do something like this with superstars as bigs as JYJ then they should also be ready to pay for their deeds. Their actions were just stupid in my opinion…they were asking to get sued

Ah, this came just as I was wondering whether some magazines had permission to use JYJ members images on their cover.
True enough some didn’t get permission and aimed to make money out of it.
I think any reputable publishing company will do the right thing and get permission or pay for the rights to use the images.
It is the those who want to make a quick buck that flaunt the law.
I understand why Cjes is taking a tough stand. Hopefully this sends a message to the rest not to do the same. It is also a way to maintain the reputation of JYJ by making sure they only appear on the covers of magazines that they consider good for their image.

somehow this is so sad…what all the lawsuit thing…it just make JYJ bad which like hunger of money…korea entertainment is going down hill with all this bad thing….they should follow japanese entertainment…they are wise & intelligent
I agree with you. Korean entertainment does not like them although they are more talented than most of idols. Because they want everything to be appropirate in rules and laws which Korean entertainment does not want. People also think that they love money more than being idol. I do not think so. They are very very talented and do their best in lots of areas. Does not reasonable that they only want what they deserve? They fight for themselves to the Korean entertainment which is sad that it is their own country and to the antifans who do not like them because of split or jealousy. We,the true fans, should support them whenever they need. I do not think they do anything wrong but they do lots of unusual things for Korean entertainment. All are because of this.

Yes they should because what kind of magazines are they being posted on …. They have to be careful of their image as it is who they are and not all advertisement is good for you… Tabloids spreading false rumors and fake contest in any ones name is harmful again people this is not about the money it is about making sure you are not slandered. These are just clever ways to do it.

I am so glad that CJES is taking a tough stand on this issue. It is plain wrong for them to use JYJ image without their permission, so that they can make a quick buck!! I do hope they win this lawsuit!!
Fight CJES fight. Every right should be protected. That’s the way to go. I pray that the Korean Intellectual property office do a massive information drive all over the country to educate the people of its benefits to them and the country and thereby correcting the misconceptions that the creators and intellectual property right owners like JYJ are mere greedy people.
