Local broadcasters may soon face tougher regulations in preventing celebrities from appearing on their programs.
On Tuesday, Rep. Choi Min-hee of the main opposition New Politics Alliance for Democracy proposed a revision to the Broadcasting Act toughening regulations against broadcasters’ unfair practices.
Dubbed the “JYJ bill,” the proposed revision would enable the Korea Communications Commission to intervene when a broadcaster bans someone without reasonable cause.
Citing the case of JYJ, Choi said that there needed to be a means to intervene in a broadcaster’s decision to ban certain individuals.
JYJ was formed by Jaejoong, Yoochun, and Junsu in 2010 when they broke away from TVXQ. Following the move, JYJ experienced friction with their former agency SM Entertainment, as a result of which they were prevented from appearing on terrestrial broadcasters’ music programs.
According to Choi, the Fair Trade Commission’s 2013 ruling in favor of JYJ has done little to enable the group to perform on television.

Assemblywoman Choi Min Hee recently proposed a bill to prevent banning, or ‘blacklisting,’ specific entertainers and artists from appearing on broadcast without a justifiable reason. This bill will be called the ‘JYJ Law.’
The bill was proposed on April 13 by assemblywoman Choi Min Hee who outlined the controversy and lawsuit between SM Entertainment and JYJ to further help her proposal.
Assemblywoman Choi Min Hee stated, “Although The Korea Fair Trade Commission announced that idol group JYJ’s previous label cannot interfere with the group’s promotion on July 2013, JYJ is still unable to appear on music programs due to the broadcasting stations’ unfair corporate practices. Sanctions are needed against TV stations and the label who is interfering with the group’s appearances on music shows.“
Just yesterday, Junsu appeared on EBS’s ‘Space Sympathy’ after six years of being off air and was seen performing his hit tracks live.
Meanwhile, also on April 13, cultural analyst Ha Jae Geun commented on EBS News, “Despite the lawsuit ending in 2012, we have not been able to see Junsu or the other members on any shows. The reason for that is broadcast companies consider the fact that SM is a huge company and there is speculation that in order to cast SM idols, they need to distance themselves from JYJ, who do not have a good relationship with SM.”

It will be interesting to see how this plays out. I expect the lobbying to be fast and furious on SM’s side to keep this from going through. There are enough features in the KCC act already that this is not necessary. The bill needs to have meaningful penalties, like broadcast licenses pulled, for this effort to work. It shouldn’t have to be this way. Just do the right thing.
I expect SM to pull out everything in their dirty bag of filthy tricks to prevent this. I’m sure keeping all their current artists in line and afraid of what will happen if they try to leave, is crucial to their business model.
Yes, pulling out all the stops is their MO. But Vendettas have a way of strangling you, if you’re not careful.
As I zoom around various internet entertainment chat sites, I’m finding that more and more people’s perception of SM is that they are a “terrible company.” People are happy to name names now – the days of cautiously referring to them as SoMeonE, etc are over. I think if SM fights this ruling, their moves will quickly become apparent and further backlash will be instant too. Then, a further drop in prestige, more people talking about how bad they are publically… maybe even another drop in their stock, who knows? I think it will become increasingly hard to intervene with their insane vendetta without negative consequences as time goes on. Then it will be down to whether having to face the prospect of JYJ going on TV and publically defeating their idol groups is still so horrifying that they feel they must continue to go to any lengths to keep that from happening.
Lili… SM’s continued vendetta against JYJ points out that they’ve never forgiven having their dirty laundry exposed. Especially with the 2 lawsuits by the former members of EXO-M. Pretty much the same allegations presented by JYJ, in effect saying nothing much has changed. And yes, the prospect of JYJ competing on the same playing field with the SM stable, is not something they want to see happen. But the bigger question becomes, how much longer dudes are you going to go on with this? At some point you will really begin to look like sore losers rather than substantial business people. Which is it?

Yes, it may be a hard fight but the trend is there – the acknowledgement is there, the fight has gotten all the way to government stepping in at last. This is a major stepping stone any way you look at it. And even if SM wins the day, everyone will see that their corruption extends all the way to the lawmakers of the land. They literally can’t prevail and keep the ban going and look innocent of all the manipulations from now on.
Don’t get me wrong my VE Sister. I would like nothing better than to see this come about. It’s just that for me, SK does not have the greatest tract record when it comes to dispensing justice. There already are enough statutes on the books for the KCC to have taken care of this mess. First and foremost is to see how the actual bill is worded. If it doesn’t contain enough or big enough sanctions for these two entities, it’s merely an exercise in futility. What I would really like to know is this Assemblywoman’s track record in getting legislation passed. There just aren’t enough cojones, or ones big enough to tell SM to go sit down somewhere!
Oh, I know where you’re coming from – there are still a lot of ifs. But the spotlight! The spotlight is now shining on this issue like never before! Is SM going to act exactly like the cockroaches they are and scurry madly away from the light now shining directly at them? Because it *is* shining Right. On. Them and no one else. They’ll try to squirm out of it any way they can so maybe once again it’s going to be up to fans to keep the pressure on them to end the madness.

This is good news! The more embarrassment to the South Korean entertainment industry with their unfair practices the better. With JYJ involved, they must know that the world is watching!
Good thing that the boys are very talented…the “ban” made them explore,enhance other talents such as acting,musicals,designing,business,etc.leading JS and JJ having solo albums and chunnie becoming a respected actor…the circumstance made them stronger and more successful than during their stay with SM.

This needs to happen, & be rigorously enforced, ASAP. It’s not right for broadcasters & companies like sm to have so much power, nor for them to be allowed to use & abuse that power so flagrantly for so many years.

Yes! It’s time for justice!
Even if this bill is passed, it’s still not easy to get “hard evidence” that the broadcasters deliberately ban any artist. They can simply cite “creative liberty” and say they are not interested in inviting them, or don’t find them suitable for the shows. It’s not only JYJ, you look at Jang Keun Suk, it’s the same thing.
But I do think JYJ will come back to public TV, if not before all their military drafts, definitely after. Not because of any law or regulations passed, but simply because SM is getting less and less influential, and the Korean entertainment industry has become more global. The Incheon Asian Games was a test case of global fans pressure working (they ended up not showing EXO on TV but made sure everybody could see JYJ). If Korea entertainment industry wants to bring in more foreign currencies, something will be more powerful than the SM lobbying money/bully.
It’s good that more and more artists (even young and new one) now dare to dispute their slavery contracts with agencies. Look at JYJ, yes, they got banned, but they gained creative freedom which is very valuable to artists, they gained money (lots of it). When I see the Super Junior or the TVXQ guys, or Girls Generation members that still live in the dorm and can’t afford to buy a nice apartment, still under tight control of the managers….. I think losing the chance to show up on TV is a small price to pay. And to be honest to us overseas fans, it doesn’t make a whole lot of difference.
I do want them to be able appear in public broadcast though, not because that’s what I want, but we all know that this is what “they” want and have hoped for.
Wow, what a great comment. Speaking of disputing the slave contracts, Kris and Luhan of EXO-M as well as Hanggeng before them have all now left and sued SM to be released from their contracts by the court. It’s been interesting to watch their progress (or lack of it) because SM is once again doing exactly the same sorts of things to them that they did to JYJ – namely stalling, stonewalling in the court mandated negotiations and launching a smear campaign against them, counter-suing via a completely bogus list of allegations. I hope they can hang in there and prevail – lawsuits are expensive wars to wage. But it just reminds me how courageous and determined JYJ were to be free.

If the bill gets passed and JYJ say they want to be on the show would the broadcasters be able to stop JYJ from appearing? Because they should have a legit reason why they think JYJ can’t be in their show. For example, I don’t know how they will find a “good” reason to stop JYJ from appearing in music programs.
Although what I said here would only work if the bill have strict penalties to those who fail to follow and whether the Korea Communications Commission is neutral and don’t let SM get them by backdoor $.

I agree. I believe the fans’ sincerity will ultimately trump SM’s campaign of lies, certainly as far as history is concerned. We have to remember what a historic battle this is, how it will be seen as having begun the reform process of the Korean music industry. There were other earlier fighters against unfair contracts to be sure, but none as high profile as JYJ. Or, I like to think, as compelling. As long as history is told honestly and factually, JYJ’s story will be a seminal one. And let’s not forget that SM has already shown themselves to be very much about the business of re-writing history as far as DBSK/JYJ is concerned and writing JYJ OUT of that history. hmm, that is a sad thing always to think of that JYJ’s equal (if not more) hard works in the old team is rewritten as none, non-existent. but the important thing is, people who are concerned, people in the industry itself, old fans and new caring fans, and the most ultimate thing –> their old discographies, won’t lie about what the actual fact that was. that is enough for me. Honestly i think, DBSK or Tohoshinki’s history is better left as it was, SM’s way of trying of erasing it, seems desperate like a bad laughing stock in my (and i suppose in many people’s) eyes who knows the truth.
let’s say they constantly need to get that done in order to mantain their self esteem or superior feeling. JYJ doesn’t need that bombastic news, celebration, smearing other’s name we-are better-than-them campaign to get such.
