[NEWS] JYJ can not appear on KBS
KBS recently announced that JYJ can’t appear on their Music Bank.
On the 18th, the program posted a note on their official homepage, “Entertainers, who is in litigation, can effect the result of the lawsuit if they appear on TV. We will watch the development of the events and then we will decide about their appearance.”
Since JYJ is currently in litigation, KBS will not allow JYJ to appear on their programs until the result come out.

On the [lack of] appearance and omission from the rankings of JYJ from KBS 2TV’s Music Bank, the two sides are again in conflict.
JYJ has recently released its first Korean-language album and is gathering a good result from the digital music and album charts. JYJ’s In Heaven has sold 165,000 copies cumulatively on Gaon Chart and the agency’s records show that it has broke 350,000 in total. At this, JYJ fans raised an en-masse objection to the fact that JYJ has been omitted from the KBS 2TV Music Bank Chart.
According to the Korea Communications Commission, Music Bank revealed: “because TV appearances and such by an entertainer who is in the middle of a lawsuit may affect the outcome of the lawsuit, we will examine whether the entertainer may appear or not while keeping tabs on the development of the situation.”
Continuing, it explained: “Currently, apart from the result of the petition for injunctive relief, there are many main suits for instance on the validity of the exclusive contract and damages. There is no change to our position that fundamentally we will postpone the appearance of the entertainer who is in the middle of the lawsuit regardless of the result of the petition for injunctive relief and that we will monitor the situation until the results are finalized.
Music Bank added: “Although the situation keeps changing such as through the release of the regular album and the content of the petition for injunctive relief, the main lawsuit between SM and JYJ is continuing still and the court is still not giving the final decision and so the position taken by the Music Bank staff has no significant changes from before.”
This is a changed position from Music Bank’s position from last May, at which time it replied on the viewers bulletin board to a question that asked the reason for JYJ’s impossibility of appearance: “Currently a legal/lawful decision has been issued. However, because JYJ has not released a regular album, the appearance on TV is difficult. JYJ has not released an official album, e.g., an OST, and so it is not a candidate for charting. If in the future an album is released, under the discussion of the production team of variety programs including Music Bank, whether they can appear or not will be examined.”

[INFO] Now that JYJ Has a “Regular Album” Out, KBS Reverts to Its Former Excuse to Ban JYJ from Music Bank
Korea Communications Commission is an agency of the executive branch dealing in broadcast communications similar to the FCC of the United States (source: Wikipedia). A JYJ fan has sent the commission an inquiry with regards to KBS situation. KCC in turn asked KBS and forwarded its reply to the fan. We provide the translation of the response below.
In short, now that JYJ has released the “official regular album” and thus this excuse no longer works, KBS reverted to its previous excuse to unsurprisingly keep banning JYJ from Music Bank. If KBS will be irrational, then the least it can do is to be consistent and thus ban both sides. After all, there are two parties to this lawsuit.
Hello. We are the Korea Communications Commission. We thank you for the interest and participation for the healthy development of broadcast communications.
As for the items that you have informed us we have requested the broadcast station in question to cooperate to confirm (the facts) and to take appropriate measures. We forward you the reply from the broadcast station as follows.

The president of KBS has announced that JYJ can request for a re-evaluation regarding their banned song, “Pierrot“.

KBS has revealed its official position on its ruling that JYJ’s Pierrot is unfit to air because it criticizes a particular person.
KBS’s deliberations office conveyed to Star News on the afternoon of the 29th on its ruling that Pierrot is unfit to air: “P.S.M is generally known in the industry to be referring to Lee Suman.” (JYJ3 Note: Wow. This is not the first time that KBS made a very obvious and easily-verifiable lie in such a strangely public manner: see here.)
They continued: “As we evaluated the whole of the lyrics, five out of the seven of the deliberation committee members evaluated that it was criticizing a particular person.”
JYJ is arguing that it did not have an opportunity to give prior explanation and that the decision was arbitrary. At this, KBS’s deliberations office revealed: “It is not an arbitrary interpretation. Out of seven members, five came to the same interpretation.” (JYJ3 Note: As even young children probably understand, plurality has nothing to do with whether something is arbitrary. A decision is arbitrary if it is made with no evidence, even if it is the majority or even the unanimous opinion.)
Continuing, they explained; “If we were to say that P.S.M. is not a designation of Lee Suman but rather an abbreviation for “professional, success, music” then it does not fit in with the rest of the lyrics.” (JYJ3 Note: JYJ, unsurprisingly, has never claimed that P.S.M. is abbreviation for “professional, success, music.” Our readers have far-better suggestions…)
KBS deliberations office revealed: “To apply for a second deliberation for a song that was deemed unfit can be done any time. If one requests the opportunity to explain, that can be done at any time. Before the deliberations, when there is an item that evokes extreme curiosity or is difficult to discern the meaning of, we do ask the writer or the affiliates for the meaning. But this is not “explaining,” it is just merely inquiring beforehand what the item in question means.” (JYJ3 Note: Obviously there is no actual distinction between the two. When one inquires about what a word means, the answering person naturally explains what it means.)

JYJ’s Kim Jaejoong has conveyed his honest feelings towards the decision by KBS that his song is unfit to air.

JYJ’s new song Pierrot has received the decision of being unfit to be aired from KBS. JYJ plans to submit an explanatory document claiming that the decision is unfair and to request a re-deliberation.
KBS recently laid the decision that the song Pierrot is unfit to be aired. The reason as presented by KBS is that it is “a personal attack against an individual.” It argues that the term p.s.m. in the lyrics mean “president Lee Soo Man” and that this holds a personal grudge toward a specific individual.
At this, JYJ has said that it is unfair and has stepped out give an immediate response. An affiliate of JYJ emphasized: “This is an arbitrary interpretation by KBS. During the deliberations process, they have never even asked us whether it is a personal attack against a certain individual. The lyrics were certainly not written to aim at someone.”
The affiliate revealed: “In the case of SBS, during their process of deliberation they asked us—“what does this word mean, it is not a swear word, is it?” If the term was unclear in meaning they can just ask. But they made an arbitrary interpretation and laid down the decision of Pierrot being unfit to air as if that interpretation was a fact. We think that to do so is unfair.”
