Note: On its statement, KBS argued that JYJ is engaging in “dual-contracting” among others. This is factually incorrect, because the JYJ-C-JeS contract is not an exclusive contract and also because the JYJ-SM contract is now null and void.
The below is a translation of the court decision that dismissed SM’s petition for the court to strike down the business relationship of JYJ and C-JeS as dual contracting. The Korean original is posted at DNBN, found here.
Notice the brevity of the court’s opinion. This petition was so without merit that it barely warranted a page to refute it in multiple ways.
KBS is severely criticized for its remarks regarding JYJ.
On May 17, 2011, KBS posted a response to a post titled ‘Request for an explanation why JYJ cannot appear on <Music Bank>’ on on KBS’s online production crew message board[on their official website.]
KBS remarked, ‘JYJ have been in the process of lawsuit with their former management company[SM], so KBS is closely monitoring the result of the lawsuit from an objective standpoint. It could influence on the current case if celebrities under lawsuit who is in the legal disputes appear on TV.”
JYJ instantly refuted this argument saying, “in the case of lawsuit that KBS has made an issue of, the court already ruled last year that SM’s subordinate contract with JYJ was invalid as the court judged that the contract was unilateral and unfair to JYJ.” They also emphasized that the court has acknowledged SM’s interference with JYJ’s activities and have been issued an indirect compulsory order.
Those in the judicial circles point out that KBS’s argument has many rooms for misunderstanding. Regarding SM’s insistence about ‘dual-contract,’ the court ruled that ‘in accordance with the judgment from the provisional injunction, SM, at this point in time, do not have any authorities to manage and/or administer the duration of the contract in Kim Jaejoong, Park Yuchun, and Kim Junsu’s entertainment activities regardless of the validity of contract.”
JYJ has been active as honorary ambassadors of various government-run projects as the ‘faces of Korea.’ On April 21, they were appointed as honorary ambassadors for World OKTA (World Overseas Korean Trader’s Association) with President Lee Myung Bak present at the ceremony. Moreover, they have also been appointed as the honorary ambassador for selection of Jeju Island for New 7 Wonders of Nature on May 3. Dominant opinions say that the fact KBS, the state-run public broadcasting company, singled out JYJ as figures who could ‘hinder development of culture industry and hold risks of obstructing order’ has gone too far.
Kim Jaejoong, Kim Junsu, and Park Yuchun have filed for a provisional injunction to invalidate the exclusive contract, and started their activities as JYJ after signing an one-off contract for business commission. Since then, theories about external pressure have were raised as JYJ’s appearances on not only music programs but entertainment variety programs such as <Win Win> and <Come To Play> were cancelled for all three major broadcasting companies.
Under these circumstances, KBS’s statement that contradicts the basic facts and the court’s judgments just resulted in incurring more resentment from the fans.

KBS has released an official statement regarding their decision to bar JYJ from appearing on their broadcasts.
The statement was posted on KBS’s online production crew message board as a response to the many requests asking for the reasons why JYJ was not allowed to make an appearance.
KBS explained,

With the recent news of KARA’s contract negotiations, and JYJ’s “Music Essay” reaching #1, the debate between management companies and artists has once again become a hot topic, and this time both sides are speaking out.
Featured in a segment called, “JYJ and KARA, why did they do it?”, on MBC’s “News Magazine 2580” (시사매거진 2580), representatives from both sides spoke out, and Junsu and Yoochun themselves discussed their controversial decision and artists’ rights.
For one of the first times, Park Yoochun confessed that he fully knew that he “might never be able to be a star again” when he decided to leave SM Entertainment, but even with this realization, he still needed to “find happiness and leave.”
Kim Junsu, Kim Jaejoong, and Park Yoochun left their band, DBSK, and management group, SM Entertainment, in July of 2009, citing differences in regards to the length and terms of contract. The best known of these claims is SM Entertainment’s lack of transparency regarding group finances, and that the 13 year term of contract was far too long. However, the boys’ decision to leave and regroup as JYJ has not been a walk in the park, especially with them facing an unstated ban from popular music programs (SBS Inkigayo, MBC Music Core, and KBS Music Bank all declined to give statements or explanations).
Regarding this, Junsu said, “I think that it is very weird that we cannot appear on broadcast television. I learned that it truly is difficult for a Korean singer to perform on a stage, and it is what I resent most.”

The popularity of JYJ, the group formed by members of Dong Bang Shin Ki who left is soaring. In addition, since this success came about after the controversy surrounding their slave contracts, the public response is hotter still. Here is the report by reporter Cho Il Soo.

Experts in the industry echo JYJ’s postion that the unfair relations between the singer and his/her agency needs to be remedied.
