A Demand Letter from JYJ Japanese fans to Avex
We, Japanese fans of Jejung, Yuchun, Junsu (hereafter, JYJ) hereby make the following demands of JYJ’s current management company, Avex.
In September 2010, with sudden announcement from your company, JYJ’s activities were suspended, and the opportunity to listen to JYJ sing was deprived from us JYJ fans. Since then, JYJ’s activities in Japan have remained suspended till this day. During this entire time, we have kept waiting for the resumption of JYJ’s Japanese activities, and have continued to send such demands to your company, but even now have not received an acceptable explanation for the suspension of their activities.
Moreover, on the matter of the earthquake relief charity event that JYJ is to hold, the representative of the venue where the event was going to be held has recently made an announcement citing contract problem with your company as a reason that has cast doubt on the materialization of the event as planned.
This event represents JYJ’s well-wishing for Japan after many years of doing activities here, and is a charity event they are to voluntarily come to Japan to conduct, as a segment of their effort expressed immediately after the earthquake to support the disaster-stricken areas. To prevent even an event purposed to revive (Japan) from happening, during a time when we as a nation need every possible effort to recover from the aftermath of this unprecedented earthquake, is an action that we feel is very questionable.
We hope for the prompt resumption of JYJ’s music activities, and hereby make demands of your company in regards to the following points.
1. C-JeS is a business entity officially registered in Korea in December 2009, its size and organization composition can be viewed by anyone on the company registry. Furthermore, your company’s Vice President has, on his Twitter, revealed his close relationship with the representative of C-JeS. Thusly your company’s assertion that you did not know about the past of C-JeS’s representative before signing the contract is entirely unconvincing.
If (despite the foregoing) your company still insists that you did not know about the past of C-JeS’s representative, and uses such as a reason to suspend the contract, then was it not a neglect of duty on your company’s part as a public listed company to do due diligence on your business partner before the fact?
2. In Korea, JYJ has been appointed to promote the G20 Summit, to promote the Overseas Korean Trader Association as honorary ambassadors, and to promote other internationally recognized Korean enterprises. Their entertainment activities have not been hampered by the fact that C-JeS is their management company.
To use a reason that did not cause any problem in (JYJ’s) home country, that the representative of C-JeS has himself denied, and to give the Japanese society false and negative impression of JYJ, we find your ground (that the reason was based on) to be very questionable.
3. When JYJ began their Japanese activities in April 2010, the problem regarding the affirmation of the three’s exclusive contract with SM was already resolved by the October 2009 court decision. Consequently, the reason your company used to suspend JYJ’s activities, “Depending on the progress of the exclusive contract affirmation lawsuit between JYJ’s three members and SM, there is a possibility that their exclusive contract with our company may become invalid” (quote from Avex’s official statement) has been rendered a non-issue.
Rather, it (the contract issue) was a problem that your company needed to resolve, as your company signed exclusive contract with JYJ while the contract signed (by Avex) with SM as Tohoshinki remained in effect, we feel your logic to make the issue a problem with JYJ is very questionable.
4. When your company, in spite of the aforementioned circumstances, used corporate compliance as a reason that your company would no longer provide management services to the three, it meant that the contract could no longer be maintained as per normal. To restrain the three with the contract while not letting them to engage in entertainment activities, we must say is very socially unjust behavior. We find it very hard to understand that in spite of the fact that both JYJ and their fans desire for (JYJ’s) Japanese activities, such a condition (the suspension of activities) has continued for as long as 8 months.
5. Moreover your company, while suspending (JYJ’s) activities in such a manner, continue to sell JYJ’s music CDs, DVDs among other products. What is more, these products were what Oricon addressed in their explanatory note as “products that were determined by your company prior to their sales to not be reflected on the Oricon ranking chart.” Notwithstanding the fact that those products were subject to such extremely unusual measures, with no advance notice given, (the action by Avex to disallow sales results of those products to be reflected on Oricon ranking chart) disappointed fans who despite feeling it’s questionable to sell (JYJ’s) products during their activity suspension, bought the products in an effort to support JYJ, and also made JYJ miss the opportunity to show their high popularity to the general public.
In April 2010, when the announcement to halt Tohoshinki activities was made, your company has declared, that “Our company intends to continue fully supporting respectively these five individuals, who are extraordinarily talented young people with a future”.
Yet for us fans who have devotedly waited for JYJ’s return since last September, we have already been deprived the chance to be close to JYJ’s music for 8 months, while your company has in effect relinquished the management of the three.
We as consumers and fans, seek (your company’s) explanation for this inconsistent situation. If there is no possibility of improvement of the current situation, (we ask you to) please as soon as possible resolve the contract problem (work out the validity or invalidity of your contract with the three), and return JYJ to their supporting fans.
We wish for the three young people with extraordinary talent, Jejung, Yuchun, and Junsu to be granted freedom to embark on a new journey of music activities, for us fans to be able to freely enjoy their music.
Note: we have not consulted Cjes or JYJ’s three members prior to writing this demand letter, the letter is presented by the Japanese fans who volunteered to participate. We ask for your understanding of this fact.

I appreciate the effort, but it seems a bit weak expecting this letter to make an honest company of Avex. It is great to let Avex know that their stories are not believed, but it still treats them as if they will behave ethically.

I’m beginning to think C-JeS have grounds to sue Avex for defamation if they wanted to.
Am sure they have the grounds too. If the previous rumor (of suing) was true, then yay. If not, i think C-Jes is too small/financially small to sue that large corporate, in their own country. I guess we will observe and do what we can.

I liked it until the end….it’s not much of a demand letter with the word ‘hope’ in it…The ending was way too nice…and they’re not gonna get what it is they want….I don’t know why they’re prolonging it….they’re gonna have to boycott. Or come up with a way to actually make a big wave. But I’m happy they’re finally trying to do something..its good to see Japan actually have a voice.
It sounds too polite in English but the original Japanese is worded in the way normal Japanese people would speak.
I think being polite is actually more effective in this case than sounding too aggressive or militant. The other night when Max was doing his drama on twitter and angry JYJ fans were tweeting him, he apparently kept retweeting the really rude tweets and blocked the people sending politely worded but very persuasive arguments against what he was saying.
Nice words are easier to ignore. It was those other tweets that mad max look as stupid as he was allowing himself to look. It was those tweets that showed his unprofessionalism and real feelings. The type of wording used here is for when someone is in the hot seat and they have to respond…..Max wasn’t in the hot seat on twitter…ans Avex be in the hot seat with this…its easy to ignore. A plea is easily ignored def to those who purposely do wrong and don’t wanna change…but a demand is the total opposite. This is a plea letter…that lets Avex know that fans know whats really going on…but a plea letter all the same.
I think that Avex won’t be able to ignore this, nice words or not, if enough people sign it. It’s probably easier to get a lot of people to sign this in Japan if it is politely worded. If enough people sign it the media might take it up. On the other hand a strongly worded demand probably won’t do much if only a couple thousand or so sign it. There are people who are urging fans to boycott Avex products. But the reality is that there are a lot of people who would be willing to sign this but wouldn’t be willing to declare a boycott. I do see a lot of fans (not just Japanese) who say “I like TVXQ, JYJ, and Super Junior.”
I really hope that international fans will be able to participate because Avex has a Asia division based in Hongkong.

In honesty it doesn’t matter how many people sign this…not to avex…they get thousands of email s everyday about jyj…and still they block them. You can’t handle companies like Avex like this…thats just honesty. But the info up there…is all fans need to make people view Avex differently they don’t even need a letter.
I agree with the boycott thing. I don’t buy anything from Avex not even the jyj stuff they put out after they dropped jyj cause it could only end badly…but people will always excuse themselves for what they want….thats why boycotting doesn’t work. In my opinion its kinda low standard…cause how do you talk about a company and see its standards…yet continue to feed its power.
Do you understand Japanese? I think the English translation sounds weaker than the original Japanese. It’s pretty near impossible to retain the exact nuance when translating Japanese into English because the languages and cultures are so different.
I agree that Avex will probably do it’s best to ignore this. The only way to force them to do anything is to sue and win anyway. But public opinion is important to them too although they pretend like they don’t care.

you can read below on what I have to say on the nice vs. demand argument…it don’t really matter like I said they’re going to ignore it like they do the thousands of other emails they get every day! And someone who cares doesn’t do and say the things they do…not when they still have those thousand plus more buying their product. You can say and believe other wise but this isn’t gonna make Avex do anything. You can only handle them two ways 1. through the courts and 2 through public knowledge. If this letter doesn’t get to the public and only stays in the fanbase…then its pointless.
I’m not sure you are getting what I’m trying to say. As a native Japanese speaker I think the original Japanese wording doesn’t sound as ‘nice’ as the English translation makes it sound. It’s not the translator’s fault, just language differences.
If you understand Japanese and you still think it’s too nice I guess we can agree to disagree. If you don’t, nitpicking over words like ‘hope’ and ‘seek’ is pointless because the nuance of those words in Japanese is different from English.
I agree with you that the only way that this will accomplish anything is if it becomes public knowledge. But that is only going to happen if a lot of fans support it, which is probably why the people who wrote it chose to write it in a way that ot5 fans (and there are a lot of ot5 fans in Japan) can come aboard. JMO

Thats A plea…not a demand…
A demand doesn’t have to sound like a threat it doesn’t have to sound mean, but it is a wording that lets one know that things must change…or be handled in a different way (in this situation) A plea…ask for a change or a handling in a different way. A plea and a demand can both be handle with class and show great points of sensibility, but has a underline different tone. The beginning of this letter starts off as a demand tone…it lets Avex know that fans know of their wrongs doings, it lets Avex know that those wrong doings aren’t efficiently covered (which depending on how one takes it can be a underlined threat..but I don’t think they actually mean it to be)they eve had a demand line in it…”We as consumers and fans, seek (your company’s) explanation for this inconsistent situation.” <—-thats as close as they got to a demand…and it wasn't even all full out (but in my opinion its nice cause its not all full out) it is a statement that does not ask…unlike the next line which pleads. In honesty we back and forth which I'm not willing to do these days but the important question isn't "is this a demand or a plea" but "what effect will this have". With Avex…lets just be honest none…this is the company whose answer was "Because were Avex". So you have to make it bigger than Avex…the public is the key. Japanese fans hold the key to Avex's ruin and just about all of it is that letter. But if no one knows of it it's useless…cause Avex…nor companies like it…ain't changing.

You know though…I think we put too much weight on japan fans…I mean yeah I was angry when they weren’t doing anything…but in honesty they’re not the only ones who can do something about Avex…they do have the most effect they’re right their but we (I-fans, Koreans, and all other JYJ fans) have the same info as them. Talking to Avex is like talking to a brick wall…useless. It’s like the more someone emails them about JYJ (wanting to see jyj and stuff) the more they try ad ruin JYJ in Japan. Avex is a company that needs to be handled the question is…how. It’s sad to see companies use pieces of paper (contracts) to ruin and harm the popularity of the people they’re supposed to be promoting and helping.

Yeah I do believe all JYJ fans and people who have standards should boycott Avex and SME. And don’t just boycott these companies for what they did to JYJ but because of the low standards these companies have, and because the way they work and how they treat people. I don’t feel like companies like these should exist so I don’t feed their pockets and their power with my money…its really that simple. To me it doesn’t matter if I like another artist under that company…at the end of the day I’m not helping these companies hurt other people’s talents and gifts. One of the many reasons why Avex will probably not care about this petition. How effective will it be if the people who signed are the same people who will continue to put money into Avex’s pockets? It’s showing Avex that they can do whatever they want because we’re still going to give them money. You gotta hit them where it hurts imo.

I´m totally agree with this. Avex using the contract as an excuse when they already said that theyr were not longer support JYJ activities is unjust and despicable.

AVEX does not know it is its own ethics that is undermined in banning JYJ. AVEX is JYJ’s agency thereby has a duty to work for the best of its artist, JYJ. So far, it is so clear that AVEX just cherishes nothing else but its own profits. It is most ludicrous to sell JYJ DVDs and goods while proclaiming that AVEX does not do any promotion. Hey, displaying DVDs on a specific shelf is an important part of promotion. Just wake up, AVEX!
They are saying on twitter that Junsu’s brother Junho is debuing from Avex in August… Now how did that happen??
