Avex appeal – Second court hearing
Date: August 6th
Time: 11:00am
- The court has instructed C and A to reach a settlement decision and will meet on Sept 9 at 1:10 pm JST for the agreement.
- Everything will be finalized on Sept 9.
- C has won the trial before. Possible that A just appealed because they want a settlement, which is the result of today’s hearing.
- It is not certain if JYJ can promote freely in Japan after this.

Hearing notes:
- Company C and Company A are currently undergoing settlement talks.
- The next hearing will be on Sept 9, 2013 at 1:10 pm JST. This is the last chance for Company A to make an argument.
- Please note that Company C already won the trial and Company A was told to pay 660M JPY to Company C. Company A filed an appeal to counter the decision. The appeals court has ordered Companies A & C to discuss the possibility of a settlement.

- If they fail to reach any settlement before the next hearing, the settlement will end in failure so it will be up to the court to set another hearing or to make a decision. This is similar to what happened in the Korea case.
- News/articles about JYJ will be published in several newspapers in Japan within 10 days.
- Legal team of Company C is in a great mood, which is completely opposite if you look at Company A’s legal team.
- It was a relatively short hearing.

Does this mean that no entertainment company in Japan would consider JYJ like they used to in the beginning of the year?

I think the appeal is just a delaying tactic. SM was able to stretch the Korean court case for 3 years and now Avex is trying to do the same thing. By the time JYJ actually gets to be on any tv to promote properly, they’ll be going into their 40’s esp since they will be wasting 2 years in the army.

Personally, I find I can never quite get my head around how ugly, how mean-spirited and unfair these big entertainment companies in Asia are. It’s something I’m just not used to I guess and I guess there’s no hope of ever getting used to it. How can music company executives demonstrate this level of malevolent small-mindedness when they don’t get their way each and every time? To a westerner who grew up in the music business in the U.S. it is a hard reality to come to terms with.
I wonder if the album for the end of the year will be affected by the settlement they were supposed to come to…i hope not. I want them to promote in Korea, Japan, China and the world over!!!!

I thought Japan’s blacklisting is worse than South Korea. However, I won’t underestimate South Korea now because of its recent fad in drama and music.

I got a feeling that JYJ is waiting for all lawsuits to be settled, broadcasting issue ironed out before launching their 3rd Album.
They will have a big glorious Chart whamming comeback!
this is what i hope for! they are waiting for the timing to be right so they can blast into action and claim some victories with another smash album AND actually be free to sing their songs on TV and programs and everywhere! and who cares if it is japan that that can happen when avex is taken care of. its always been koreas big loss and the worlds big gain! lets be positive and help the black cloud move off of jyj finally!
Well hopefully JYJ and Avex can come to a settlement and this do not drag on. That the only thing JYJ will have to settle on is the amount of money that Avex will have to still pay or not at all. That JYJ being able to promote freely in Japan will be a given and not taken away. I am just hoping for the best for them and for this to end soon with a positive outcome.

Let’s hope that by next month, JYJ’s return to Japan gets a go-ahead. The court has already ruled that Avex does not have exclusive management rights to JYJ; so technically, JYJ are free to sign with whomever, and I am sure that quite a few Japanese companies are interested. I think the hearings probably mainly deal with Avex’s appeal of the amount of money the court awarded to JYJ. Perhaps a settlement is in the works.
As for the delay in the long awaited announcement of JYJ’s new Japanese agency, I am just wondering whether this delay is tied to Avex’s appeal. Perhaps JYJ and their next record label are awaiting the the court’s verdict, for the outcome could potentially affect the negotiation of contract terms–perhaps most relevant being clauses that define/limit a company’s power to unilaterally suspend the activities of its artists. Avex burned JYJ badly when it abruptly stopped promoting JYJ back in 9/2010, claiming that Cjes’s CEO is affiliated to organized crime; therefore, it doesn’t want to work with Cjes. I am sure Cjes/JYJ does not want history repeating; but record labels also don’t want to lose that leverage, either.
Regardless, I hope that their new Japanese agency is very powerful so that it can hold its own against Avex; and also not afraid that it will lose its business ties with other Korean agencies. Hope that JYJ does not sign with a small company like CJes because it would be heartbreaking to see our boys being kicked around in Japan as well.
Please, C-jes! Make sure Avex will pay the compensation to the boys & you guys! Don’t let them get away like SM thugs did. Don’t give them any pity cos they never pitied you guys anyway. If they seek a compromise, be sure it’s worth & REALLY benefits JYJ!

JYJ can promote IF they can get an equally stronger company or label to work with them .
that’s the only way they can , both in Japan and Korea …. because it doesn’t look like SM will lose weight in the entertainment industry anytime soon .
But the downside seems to be that all the strong companies or labels work the same way as SM & Avex, & personally I’d rather not see JYJ ever perform again than have to go through the kind of hell they suffered at SM. I’m wondering if the Japanese companies JYJ/CJes were talking too wanted too much from the guys & if they’ve decided not to sign with any of them for the time being. Better not to sign to anyone than to be stuck with a company that’s going to bleed you dry & expect you to thank them for the privilege.

I so agree with you, Sapphie. From a purely economic standpoint they are doing very well now. Yes, they’d wish to have the freedom to promote as they have done in the past in Japan but they pricetag may have been too high with any of the big companies.
I mean a label like warner music ….someone that would fully back them up in music and not just do part of it .
they could have their own management company but have a strong label handle the work , so that the A-wholes with their big ass companies can star working on developing their own people rather than spend their time and money bullying JYJ .
Ah, the ever present settlement. Just tell them again how much they owe them, make them pay it and get over it. Between SM and AVEX, I’ve never seen a bigger group of cry babies in my life! Butt hurt seems to be their natural state of being. Goodness knows how they would act if they were normal. Just saying.

I think JYJ has been waiting for everything to be cleared up before releasing their next album. The delay is really killing all of us. I almost can’t stand it, like time is standing still.
I hope Japan opens up for them and doesn’t succumb to the darkness Korea has accepted towards JYJ. I feel so bad for JYJ. Wish we could all give them a big group hug.

In the U.S., settlement is an option by the parties and cannot be instructed by the courts. Japan may be different, but I somewhat doubt it because the essence of a settlement is for at least one party not to go to trial. Furthermore, once the trial has make a decision, it’s too late for the parties to settle. The settlement is supposed to preclude trial.

News is a time sensitive topic. It’s not necessary to wait for the 10 days. We should report right now.
Avex to pay 660 million yen = 6.8 ++ million USD
After paying legal fees and other expenses, hope the boys get USD 6 million.
Dont back down JYJ. Get your victory and the money you lost for not being able to promote in Japan.

For me, I started supporting JYJ when I learned about the corruption and bribery in South Korea and I stopped supporting all SM artists when I learn that my previous support means I was supporting that corruption and bribery. There are too many ignorant K-pop fans who don’t know SM’s true and ugly face. Ignorant fans only see the pretty boys and girls dancing on stage. Despicable!

I guess there’s ignorant and then there’s brainwashed. What a combo right? Kpop built itself on cultivating fans who respond to visual stimulation, most wouldn’t recognize quality music if they tripped over it. The industry would not survive if this weren’t the case. I saw somewhere that SM just released the 3rd version of SHINee’s third album, I believe it is. Now how’s that for innovation! So, if people are conditioned to go along with this, how sad is that?

I’m old school, really old school. I know how to hang in there. Been there, seen that, done that. Bullies do not make me queasy, they make me fighting mad! I’ve been a fan for a relatively short time, since 2007. But I also know truth to light when I see it, and JYJ’s fight against SME was just that, truth to light. Take some deep cleansing breaths, from time to time, they will help get you over the hump. 😉
It sounds like you’re a fighter. I like your spirit. With a personality like yours, SM cannot be prevail. The issue is whether we can make more K-pop fans more informed of the reality.
When I say old school, I mean it. Civil Rights Era and the Viet Nam War (rallies and protest marches). Doesn’t get anymore old school than that. And no, I’m not bashful about telling my age. It does have it’s privileges from time to time. LOL. Just ask my VE Sister, @lilibaiyu 😉
